{"data":{"id":"us-ky/krs-141.435","jurisdiction":"us-ky","citation":"KRS 141.435","heading":"Definitions for KRS 141.435 to 141.437.","body":"As used in KRS 141.435 to 141.437:\n(1) \"Active solar space-heating system\" means a system that:\n(a) Consists of solar energy collectors that collect and absorb solar radiation\ncombined with electric fans or pumps to transfer and distribute that solar heat;\n(b) May include an energy storage space-heating system to provide heat when the\nsun is not shining; and\n(c) Is installed by a certified installer;\n(2) \"Certified installer\" means an installer who has satisfied the professional\ncertification standards established by the North American Board of Certified Energy\nPractitioners (NABCEP) and who has been certified as a NABCEP Certified Solar\nPV Installer or a NABCEP Certified Solar Thermal Installer;\n(3) \"Combined active solar space -heating and water -heating system\" means a system\nthat meets the requirements of both an active solar space-heating system and a solar\nwater-heating system and is installed by a certified installer;\n(4) \"Commonwealth\" means the Commonwealth of Kentucky;\n(5) \"Dwelling unit\" includes a manufactured home as defined in KRS 100.348;\n(6) \"Energy-efficient interior lighting system\" means an interior lighting system that\nmeets the maximum reduction in lighting power density requirements for the federal\nenergy efficient commercial building deduction under 26 U.S.C. sec. 179D, as in\neffect December 31, 2007;\n(7) \"Energy-efficient heating, cooling, ventilation, or hot water system\" means a\nheating, cooling, ventilation, or hot water system that meets the requirements for the\nfederal energy-efficient commercial building deduction und er 26 U.S.C. sec. 179D,\nas in effect December 31, 2007;\n(8) \"Energy-efficient windows and storm doors\" means windows and storm doors that\nare:\n(a) ENERGY STAR-labeled; and\n(b) Certified by the National Fenestration Rating Council as meeting the North -\nCentral U.S. climate zone performance standards for U -factor (nonsolar heat\nconductance), solar heat gain coefficient, air leakage, visible -light\ntransmittance, and condensation resistance;\n(9) \"ENERGY STAR\" shall have the same meaning as in KRS 56.770;\n(10) \"Installed cost\" means the following, less any discounts, rebates, sales tax,\ninstallation-assistance credits, name-referral allowances, or other similar reductions:\n(a) The purchase cost of equipment, components, and associated design; and\n(b) Labor costs properly allocable to the on -site preparation, assembly, and\noriginal installation of the property, including piping or wiring to interconnect\nsuch property to the dwelling unit or commercial property;\n(11) \"Passive solar space-heating system\" means a system that:\n(a) Takes advantage of the warmth of the sun through the use of design features\nsuch as large south -facing windows and materials in the floors or walls that\nabsorb warmth during the day and release that warmth at night;\n(b) Includes one (1) or more of the following designs:\n1. Direct gain which stores and slowly releases heat energy collected from\nthe sun shining directly into the building and warming materials such as\ntile or concrete;\n2. Indirect gain which uses materials that are located between the sun and\nthe living space such as a wall to hold, store, and release heat; or\n3. Isolated gain which collects warmer air from an area that is remote from\nthe living space, such as a sunroom attached to a house, and the warmer\nair flows naturally to the rest of the house; and\n(c) Meets the guidelines and technical requirements for passive solar design\nestablished by administrative regulation pursuant to KRS 141.436(7);\n(12) \"Qualified energy property\" means the following property that meets the\nperformance, quality, and certification standards of and that would have been\neligible for the federal tax credit for residential energy property expenditures under\n26 U.S.C. sec. 25C, as it existed on December 31, 2007:\n(a) An electric heat pump water heater;\n(b) An electric heat pump;\n(c) A closed loop geothermal heat pump;\n(d) An open loop geothermal heat pump;\n(e) A direct expansion (DX) geothermal heat pump;\n(f) A central air conditioner;\n(g) A natural gas, propane, or oil furnace or hot water heater;\n(h) A hot water boiler including outdoor wood-fired boiler units; or\n(i) An advanced main air circulating fan;\n(13) \"Solar photovoltaic system\" means a system for electricity generation that:\n(a) Includes solar photovoltaic panels, structural attachments, electrical wiring,\ninverters for converting direct current output to alternating current, and\nappropriate controls and safety measures for output monitoring;\n(b) Meets the requirements of Article 690 of the National Electrical Code;\n(c) Uses solar photovoltaic panels and inverters that are rated and listed by\nUnderwriters Laboratories; and\n(d) Is installed by a certified installer;\n(14) \"Solar water-heating system\" means a system that:\n(a) Uses solar-thermal energy to heat water;\n(b) 1. Is an indirect pressurized glycol system that uses propylene glycol; or\n2. Is an indirect drainback system that uses distilled water or propylene\nglycol;\n(c) Uses OG-100 solar thermal collectors that are:\n1. Certified by the Solar Rating and Certification Corporation; and\n2. Covered by a manufacturer's warranty of not less than five (5) years;\n(d) Is installed by a certified installer; and\n(e) Is warranted by the certified installer for a period of not les s than two (2)\nyears;\n(15) \"Upgraded insulation\" means insulation with the following R-value ratings:\n(a) Attic insulation rated R-38 or higher;\n(b) Exterior wall, crawl space, and basement exterior wall insulation rated R -13\nor higher; and\n(c) Floor insulation rated R-19 or higher; and\n(16) \"Wind turbine\" or \"wind machine\" means a turbine or machine used for generating\nelectricity that:\n(a) Is certified as meeting the United States Wind Industry Consensus Standards\ndeveloped by the American Wind Energy Ass ociation in partnership with the\nUnited States Department of Energy;\n(b) Is covered by a manufacturer's warranty of not less than five (5) years;\n(c) Is in compliance with all relevant building codes, height restriction variances,\nother special code requirements, and zoning ordinances;\n(d) Has been installed in accordance with all building codes and all permits were\nreceived prior to the start of construction and installation;\n(e) Is in compliance with all applicable Federal Aviation Administration\nregulations;\n(f) Meets all requirements of Article 705 of the National Electrical Code for\nelectrical components and installations; and\n(g) Is rated and listed by Underwriters Laboratories.","path":["KRS Chapter 141"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29158","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:35Z","sha256":"831db832a589d060a8528c7033200973c131bc1e42701130b756f33ef005c8f2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-141.434","next":"us-ky/krs-141.436"},"notice":"GroundRules: Original legal text.
