{"data":{"id":"us-ky/krs-141.502","jurisdiction":"us-ky","citation":"KRS 141.502","heading":"Definitions for KRS 141.500 to 141.528   (See LRC Note below)","body":"As used in KRS 141.500 to 141.528:\n(1) \"Account-granting organization\" or \"AGO\" means a nonprofit organization that\ncomplies with the requirements of KRS 141.500 to 141.528 and:\n(a) Receives contributions, allocates funds, and administers EOAs; or\n(b) Is an intermediary organization;\n(2) \"Contribution\" means a donation in the form of cash or marketable securities that is\neligible for the tax credit permitted by KRS 141.522;\n(3) \"Curriculum\" means a complete course of study for a particular content area or\ngrade level;\n(4) \"Education opportunity account\" or \"EOA\" means the account to which funds are\nallocated by an AGO to the parent of an EOA student in order to pay for expenses\nto educat e the EOA student pursuant to the requirements of KRS 141.500 to\n141.528;\n(5) \"Education service provider\" means a person or organization that receives payments\nfrom an EOA to provide educational materials and services to EOA students;\n(6) \"Eligible student\" means a resident of Kentucky who:\n(a) Is a member of a household with an annual household income at the time of\ninitially applying for an EOA from an AGO under this section of not more\nthan one hundred seventy -five percent (175%) of the amount of household\nincome necessary to establish eligibility for reduced-price meals based on size\nof household as determined annually by the United States Department of\nAgriculture applicable to the Commonwealth, pursuant to 42 U.S.C. secs.\n1751 to 1789;\n(b) Has previously received an EOA from an AGO under this section; or\n(c) Is a member of the household of an eligible student that currently has an EOA\nfrom an AGO under this section;\n(7) \"Eligible taxpayer\" means an individual or business, including but not limited to a\ncorporation, S corporation, partnership,  limited liability company, or sole\nproprietorship subject to tax imposed under KRS 141.020, 141.040, or 141.0401;\n(8) \"EOA student\" means an eligible student who is participating in the EOA program;\n(9) \"Income\" has the same meaning as in the United State s Department of Agriculture,\nFood and Nutrition Service, Child Nutrition Programs, Income Eligibility\nGuidelines, Federal Register Vol. 83, No. 89, published May 8, 2018, and as\nupdated annually as authorized by 42 U.S.C. sec. 1758(b)(1)(A);\n(10) \"Intermediary organization\" means a nonprofit organization that complies with the\nrequirements of KRS 141.500 to 141.528 and receives contributions to fund AGOs;\nand\n(11) \"Parent\" means a biological or adoptive parent, legal guardian, custodian, or other\nperson with legal authority to act on behalf of an EOA student.","path":["KRS Chapter 141"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51406","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:35Z","sha256":"ba4bc91c964aae458e8b46448b4a19d58497e2e7b8620232de78fe88abb2d376","source_id":"us-ky","stale":false,"prev":"us-ky/krs-141.500","next":"us-ky/krs-141.504"},"notice":"GroundRules: Original legal text.
