{"data":{"id":"us-ky/krs-143a.100","jurisdiction":"us-ky","citation":"KRS 143A.100","heading":"Audit -- Additional assessment -- Determination of liability when","body":"business discontinued -- Statute of limitations.\n(1) As soon as practicable after each return is received, the department shall examine\nand audit it. If the amount of tax computed by t he department is greater than the\namount returned by the taxpayer, the excess shall be assessed by the department\nwithin four (4) years from the date the return was filed, except as provided in\nsubsection (4) of this section and except that in the case of a failure to file a return\nor of a fraudulent return the excess may be assessed at any time. A notice of such\nassessment shall be mailed to the taxpayer. The time herein provided may be\nextended by agreement between the taxpayer and the department.\n(2) For the purpose of subsections (1) and (4) of this section, a return filed before the\nlast day prescribed by law for the filing thereof shall be considered as filed on such\nlast day.\n(3) When a business is discontinued, a determination may be made at any time\nthereafter within the periods specified in subsection (1) of this section as to liability\narising out of that business, irrespective of whether the determination is issued prior\nto the due date of the liability as otherwise specified in KRS 143A.080.\n(4) Notwithstanding the four (4) year time limitation of subsection (1) of this section, in\nthe case of a return where the tax computed by the department is greater by twenty -\nfive percent (25%) or more than the amount returned by the taxpayer, the excess\nshall be assessed by the department within six (6) years from the date the return was\nfiled.","path":["KRS Chapter 143A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29264","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:37Z","sha256":"0dfdb61af60feca115041d768c3c4a60876ffe5df3b4e98158341381c3caa778","source_id":"us-ky","stale":false,"prev":"us-ky/krs-143a.090","next":"us-ky/krs-143a.110"},"notice":"GroundRules: Original legal text.
