{"data":{"id":"us-ky/krs-146.090","jurisdiction":"us-ky","citation":"KRS 146.090","heading":"Soil and Water Conservation Commission.","body":"(1) The secretary of the Energy and Environment Cabinet, with the approval of the Soil\nand Water Conservation Commission shall divide the state into nine (9) soil and\nwater conservation areas which shall contain as nearly as practicable, an equal\nnumber of soil and water conservation districts.\n(2) The Soil and Water Conservation Commission shall consist of nine (9) members,\nnot more than five (5) of whom shall be of the same political party, to be appointed\nby the secretary of the Energy and Environment Cabine t with the approval of the\nGovernor.\n(3) One (1) member shall be appointed from each of the areas from a list of two (2)\nnames submitted from each area by the Kentucky Association of Conservation\nDistricts. All members of the commission shall be supervisor s of soil and water\nconservation districts.\n(4) The term of office of each member shall be four (4) years; provided that, whenever\na member of the commission ceases to hold the office of district supervisor by\nvirtue of which he or she is serving on the commission, his or her term of office as a\nmember of the commission shall be terminated. In the case of any vacancy other\nthan the one (1) caused by the expiration of a term, the secretary of the Energy and\nEnvironment Cabinet, with the approval of the Gover nor, shall appoint the\nsuccessor from a list of two (2) names submitted by the Kentucky Association of\nConservation Districts from the area which was represented by the former member.\nThe successor shall also be a supervisor of a soil and water conservation district.\n(5) The members of the commission shall designate a chairman from among their\nmembers and may from time to time change such designation. The commission\nshall keep a record of its official actions. A majority of the commission shall\nconstitute a quorum. The commission may call upon the Attorney General for legal\nservices as it may require. It may delegate to its chairman, any of its members, the\ndirector of the division, or any officer, employee, or agent, powers and duties as it\ndeems proper. Members of the commission shall receive no compensation for their\nservices, but shall be entitled to expenses, including traveling expenses, necessarily\nincurred in discharging their duties.\n(6) The following persons are advisory members of the commission by  virtue of their\noffices: the secretary of the Energy and Environment Cabinet, the Commissioner of\nAgriculture, the director of the agricultural experiment station, the director of\nvocational education, and the state conservationist of the United States De partment\nof Agriculture.","path":["KRS Chapter 146"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53618","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:37Z","sha256":"2fc9b30721dd029dc094e3665cd7b93723249fca75236f69793a4a298afcd781","source_id":"us-ky","stale":false,"prev":"us-ky/krs-146.080","next":"us-ky/krs-146.100"},"notice":"GroundRules: Original legal text.
