{"data":{"id":"us-ky/krs-146.115","jurisdiction":"us-ky","citation":"KRS 146.115","heading":"Kentucky soil erosion and water quality cost -share fund -- Uses --","body":"Administrative regulations.\n(1) There is established the \"Kentucky Soil Erosion and Water Quality Cost -Share\nFund\" to be administered by the Soil and Water Conservation Commission. Moneys\nfrom the fund shall be used for cost -share programs to provide financial assistance\nfor implementation of best management practices for the following purposes:\n(a) Providing cleaner water through the reduction in sediment loading of\nKentucky streams, rivers, and lakes;\n(b) Reducing the loss of topsoil vital to the sustained production of food and\nfiber; and\n(c) Preventing surface water and groundwater pollution.\n(2) The commission is empowered to promulgate administrative regulations\nestablishing practices eligible for cost -sharing funds, prioritizing applications, and\nprescribing amounts and limits of cost sharing. Practices eligible for cost -sharing\nfunds shall include agricultural and silvicultural practices. Local conservation\ndistricts shall determi ne the eligibility of persons to receive the funds allocated to\nthe districts by the commission. Priority for funding within each local conservation\ndistrict shall be given to animal waste management systems, where animal waste\nhas been identified as a wat er pollution problem, and to members of an agricultural\ndistrict.\n(3) Any person engaged in agricultural or silvicultural production may be considered\nfor funding under this section if the person has had prepared a soil and water\nconservation plan with the  local conservation district, has had prepared a forest\nmanagement or forest stewardship plan, or has had prepared a groundwater\nprotection plan and agrees to maintain best management practices for a period of\ntime specified by the commission.\n(4) Up to fi ve percent (5%) of any total annual appropriation may be used for\nadministrative costs of the local conservation districts and the commission.","path":["KRS Chapter 146"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29292","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:37Z","sha256":"92b2fe792b461c9a931a5f556eef1b1d295256baaf7742e7faf45a3a6703935e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-146.110","next":"us-ky/krs-146.120"},"notice":"GroundRules: Original legal text.
