{"data":{"id":"us-ky/krs-146.610","jurisdiction":"us-ky","citation":"KRS 146.610","heading":"Duties of Office of Kentucky Nature Preserves -- Authority for","body":"administrative regulations -- Criteria for designation of plants as endangered\nor threatened -- Plant lists -- Quadrennial report.\n(1) The office may conduct investigations, with th e permission of the landowner, on\nany species of plants indigenous to the Commonwealth necessary to develop\ninformation relating to population, distribution, habitat needs, limiting factors, and\nother biological and ecological data, and to determine protec tive measures and\nrequirements necessary for its survival.\n(2) (a) Any plant species identified as endangered or threatened by the Endangered\nSpecies Act shall be automatically and immediately considered in a similar\ncategory under KRS 146.600 to 146.619. The office may promulgate\nadministrative regulations, upon recommendation of the office, identifying\nany other species of plant within the state as an endangered or threatened\nspecies as a result of any one (1) of the following factors:\n1. The present or threatened destruction, modification, or curtailment of its\nhabitat or range;\n2. Overutilization for commercial, recreational, scientific, educational, or\nprivate purposes;\n3. Disease, predation, or vandalism;\n4. The inadequacy of existing regulatory mechan isms affecting the\ncontinued existence within the state; or\n5. Other factors affecting its continued existence within the state.\n(b) The cabinet may, upon recommendation of the office, promulgate\nadministrative regulations setting forth criteria for identi fying and designating\nspecies of plants native to Kentucky which are in danger of extirpation within\nthe Commonwealth or threatened with becoming endangered in the\nCommonwealth. The cabinet may, upon recommendation of the office,\npromulgate administrative regulations that identify species that it determines\nto be endangered or threatened. These lists shall identify the common and\nscientific names of each species. The lists shall include all plant species native\nto Kentucky which are listed as endangered or threatened on the \"United\nStates List of Endangered and Threatened Plants\" pursuant to the Endangered\nSpecies Act of 1973, 87 Stat. 884, 16 U.S.C. secs. 1531 -1543, as amended.\nThe lists may also include species listed in the appendices of the \"Convention\non International Trade in Endangered Species,\" signed March 3, 1973, as Ex.\nDoc. H, 93rd Congress, 1st Session. Further, the office may provide for public\neducation purposes lists of plant species which may become threatened in the\nfuture through habitat loss, commercial exploitation, or other means, or which\nare presumed to be extirpated within the Commonwealth. All lists shall be\nupdated at least every four (4) years.\n(3) Locational and population health information relating to endangered or threatened\nand other plant species shall be kept in the office's natural heritage database.\nInformation to be considered when adopting, amending, or rescinding endangered\nor threatened plant species lists as required in this section shall be recorded in the\nnatural heritage database prior to use in determining the status of a plant species.\n(4) The office shall present to the Governor and the General Assembly a report on or\nbefore October 1 every four (4) years on the conditions and needs of the\nCommonwealth's endangered or threatened plant species.\n(5) In carrying out programs authorized by KRS 146.600 to 146.619, the office may\nenter into agreements or contracts with federal agencies, other states, agencies or\npolitical subdivisions of the Commonwealth, or with individu als or private\norganizations for administration and management of any program established under\nKRS 146.600 to 146.619 or utilized for the protection of endangered or threatened\nplant species.","path":["KRS Chapter 146"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47563","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:38Z","sha256":"ff40b79d167550d55e9a895ac34578c1402ff1cbef4e7c8746b1d41a34387872","source_id":"us-ky","stale":false,"prev":"us-ky/krs-146.605","next":"us-ky/krs-146.615"},"notice":"GroundRules: Original legal text.
