{"data":{"id":"us-ky/krs-147.640","jurisdiction":"us-ky","citation":"KRS 147.640","heading":"Area council -- Membership -- Relation to commission.","body":"(1) In order to provide more effective representation of the various governmental units\nparticipating in the creation of the area planning commission, an area council shall\nbe created.\n(2) The area council shall be composed of one (1) representative and one (1 ) alternate\nfrom each municipality and county within the area planning territory. Each such\nrepresentative and alternate shall be appointed annually in the manner prescribed by\nlaw respecting appointments by such city or county.\n(3) Only elected officials of each respective jurisdiction shall be eligible for\nappointment to the area planning council.\n(4) At its first regular meeting in each year, the council shall elect from its membership\na president and vice president. The vice president shall have the aut hority to act as\npresident of the council during the absence or disability of the president.\n(5) The council may appoint from within or without its own membership a secretary,\nprescribe his duties and fix his compensation.\n(6) The council shall act in a su pervisory and advisory capacity with the area planning\ncommission created hereunder. All actions taken by the council must receive the\naffirmative vote of the following, if in attendance: two (2) counties or two (2) cities\nwith a population equal to or gre ater than fifteen thousand (15,000) based upon the\nmost recent federal decennial census or one (1) county and one (1) city with a\npopulation equal to or greater than fifteen thousand (15,000) based upon the most\nrecent federal decennial census and a majori ty of the remaining membership in\nattendance for passage.\n(7) The area council may budget in each year for the payment of a per diem for each\nmember of the area planning commission not to exceed in any one (1) year the sum\nof one thousand dollars ($1,000) for each member.\n(8) A quorum of the area council shall consist of a majority of its membership.","path":["KRS Chapter 147"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43805","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:39Z","sha256":"5f4bafad418b314f4de19514771be13de6c3d96c018bd863e2118f8208e8f793","source_id":"us-ky","stale":false,"prev":"us-ky/krs-147.635","next":"us-ky/krs-147.650"},"notice":"GroundRules: Original legal text.
