{"data":{"id":"us-ky/krs-147a.028","jurisdiction":"us-ky","citation":"KRS 147A.028","heading":"Public purpose -- Local government parks and recreational facilities","body":"fund established -- Distribution of funds by commissioner.\n(1) In enacting a parks establishment aid law, it is the intention of the General\nAssembly to supplement local efforts to establish park and recreational facilities.\nThe inadequacy of present facilities and the high cost of acquisition and\nestablishment of park recreational facilities are hereby declared to be matters of\npublic interest and concern and vital to the promotion of the health, welfare, and\nindustrial development of the inhabitants of the Commonwealth.\n(2) The commissioner of the Department for Local Government shall cause to be\nestablished in the Treasury a special fund to be known as the local government\nparks and recreational facilities fund, to be administered by the commissioner. The\nfund shall be comprised of grants, contributions, appropriations, and\nintergovernmental transfers. Moneys in the fund shall not lapse at the end of the\nfiscal year.\n(3) The commissioner may, when he determines that a proposed local government plan\nfor a park or other recreational facility would serve the public interest, use moneys\nfrom the local government parks and recreational facilities fund to aid local\ngovernmental units in th eir acquisition and establishment of local parks and\nrecreational facilities, provided that local governmental units must provide\nmatching funds for the project. The Department for Local Government may grant an\namount up to five hundred thousand dollars ($ 500,000) for any one (1) project,\nwhich amount shall not exceed fifty percent (50%) of the cost of the entire project.\nFor the purposes of this section, local governmental units shall mean county\ngovernments, urban -county government, and governments of cit ies of any class.\nTitle to parks and recreational facilities acquired by the use of funds authorized by\nthis section shall vest in the local governmental unit which proposed the project and\nprovided the matching funds.\n(4) In September of each year, the co mmissioner shall determine the amount of funds\navailable for distribution by December 31 of that same year. The commissioner may\nprescribe standards for determining the amounts to be granted for local projects and\nany administrative regulations as may be n ecessary to implement the provisions of\nthis section. Funds granted by the Department for Local Government shall be spent\nby the local governing authorities only for the acquisition and establishment of\nparks and recreational facilities or major improvemen ts or additions to existing\nparks and shall not be used for operating or maintenance expenses.","path":["KRS Chapter 147A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1647","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:39Z","sha256":"0d21cc66ef2a30dbe2521fd554da2f9e95ad9d928e8ad5aa67aa87018e05ffc2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-147a.027","next":"us-ky/krs-147a.029"},"notice":"GroundRules: Original legal text.
