{"data":{"id":"us-ky/krs-147a.031","jurisdiction":"us-ky","citation":"KRS 147A.031","heading":"Procedures for solid waste management  conflict resolution.","body":"(1) The  Department for Local Government, in cooperation with cities, counties,\nwaste  management  districts, waste  industries, and  the  Energy  and\nEnvironment Cabinet shall develop procedures designed to resolve conflicts\nresulting from municipal solid waste management  facility siting and operation.\nThe procedures shall address:\n(a) Resolution of conflicts associated with multijurisdictional municipal solid\nwaste management  facilities, including the use of such techniques as\nnegotiation, mediation, or arbitration to address issues, including but not\nlimited to host community compensation and collection and disposal fees;\nand\n(b) Resolution of issues, except those relating to permit conditions imposed\nby the cabinet, resulting from municipal solid waste management  facility\nsiting and operation, including the use of such techniques as negotiation,\nmediation, or arbitration to address concerns of those persons and\nlandowners  who  are directly affected by the facility's location and\noperation. Issues which may be addressed include but are not limited to\nthe following:\n1. Operational issues, such as hours of operation;\n2. Recycling and composting efforts that may be implemented;\n3. Protection of property values;\n4. Traffic routing and road maintenance; and\n5. Establishment of local advisory committees.\n(2) The Department for Local Government shall adopt administrative regulations to\nimplement the provisions of subsection (1) of this section.\n(3) Nothing in this section shall be construed to abridge any rights or remedies\nprovided by KRS Chapters 109 and 224, or at common  law.","path":["KRS Chapter 147A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46528","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:39Z","sha256":"4d5545bb70782a20ebaf4d8be306ca55067d67d611423a17cc01ef240f461cd9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-147a.030","next":"us-ky/krs-147a.032"},"notice":"GroundRules: Original legal text.
