{"data":{"id":"us-ky/krs-147a.116","jurisdiction":"us-ky","citation":"KRS 147A.116","heading":"Required compliance  with laws governing open  meetings  and","body":"records,  procurement,  a  code  of  ethics, conflicts of  interest,\nwhistleblower protections, and compensation.\n(1) By January 1, 2018, each area development district and any board, committee,\nor other organization created by an area development district shall:\n(a) Comply  with the provisions of KRS 61.870 to 61.884;\n(b) Comply  with the provisions of KRS 61.800 to 61.850;\n(c) Comply  with state and federal procurement statutes and administrative\nregulations, as applicable;\n(d) Comply  with and be subject to the provisions of KRS  65A.070 by either\nadopting a code of ethics or abiding by the applicable code of ethics\npursuant to KRS 65A.070;\n(e) Adopt policies to address conflicts of interest for employees and board\nmembers  of the area development districts, which shall include a\nprohibition on employees and board members  having any interest, either\ndirect or indirect, in any contract entered into by the area development\ndistrict or any agency created by the area development district;\n(f) Be subject to the provisions of KRS 61.101 to 61.103;\n(g) Subject to the provisions of KRS  147A.070(4), adopt, implement, and\nmaintain a detailed and equitable compensation policy for its employees;\nand\n(h) Establish and maintain an independent process to receive, analyze,\ninvestigate and resolve concerns relating to the area development district,\nincluding alleged violations of the code of ethics or any of the provisions\nof this section. The process shall include a monthly reporting requirement\nto the board members  of the area development district of any reported\nconcerns or alleged violations. If the process finds a reasonable likelihood\nthat a violation exists, then that alleged violation shall be reported to the\nDepartment for Local Government, the Auditor of Public Accounts, and\nthe Attorney General.\n(2) By July 1, 2020, each area development district and any board, committee, or\nother organization created by an area development district shall provide public\naccess  to financial information in compliance with the provisions of KRS\n65.312(4).","path":["KRS Chapter 147A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45812","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:39Z","sha256":"79439c8304d687edbe1cef0186dadd293ee7fcce0e53e38e2c8f70ada1a72ac3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-147a.115","next":"us-ky/krs-147a.117"},"notice":"GroundRules: Original legal text.
