{"data":{"id":"us-ky/krs-148.021","jurisdiction":"us-ky","citation":"KRS 148.021","heading":"Functions, powers, duties of department.","body":"(1) The Department of Parks shall exercise all administrative functions of the state\nrelating to the operation of state parks, shrines, monuments, and museums except\nthose allocated to the historical society.\n(2) The department may request acquisition, subject  to the provisions of KRS Chapters\n42, 45, 45A, 56, and the provisions made in this chapter, of lands by purchase,\nlease, or otherwise, on which to operate state parks.\n(3) The department may improve said parks by constructing and equipping\nimprovements or facilities in said parks.\n(4) The department may operate said parks, fix fees and charges for the use of said\nparks and the improvements and facilities constructed therein, and provide for the\ncollection of said fees and charges and the proper accounting therefor, except that:\n(a) The department shall not impose boat launching fees at any boat ramp over\nwhich it has authority and control;\n(b) The department shall not allow, grant permission to, or permit any individual,\nsole proprietorship, partnership, co rporation, limited liability company, or\nother form of business arrangement to which the department has granted a\nrental or leasehold interest or has engaged to manage or operate facilities that\ninclude a public boat launching ramp, to charge a boat launch ing fee at any\nboat ramp; and\n(c) 1. The department shall not impose on graduates of the PGA HOPE\nprogram any green fees or associated golf rates except fees for golf cart\nrental.\n2. To claim the fee and rate exemption provided by this paragraph, a PGA\nHOPE graduate shall present his or her valid PGA HOPE graduate card\nat the time of purchase, and the exemption shall extend to the PGA\ngraduate and one (1) guest.\n3. As used in this paragraph, \"PGA HOPE program\" means the Helping\nOur Patriots Everywhere program established by the Professional\nGolfers' Association of America's Reach Foundation, which introduces\nand teaches golf to veterans and active -duty military to en hance their\nphysical, mental, social, and emotional well-being.\n(5) The Department of Parks is authorized to enter into any agreement with the Breaks\nInterstate Park Commission for the operation of any facilities in the Breaks\nInterstate Park.\n(6) The Department of Parks is authorized to accept, for deposit in a trust and agency\nfund account in accordance with KRS 45.253, on behalf of the state any grant or\ncontribution, federal or otherwise, to assist in meeting the cost of carrying out the\nfunctions assigned to the Department of Parks.\n(7) Notwithstanding any provision in KRS Chapter 41, 45, 45A, or 47 to the contrary,\nthere may be established separate cash funds and depositories at each state park\nfrom which immediate payment of refunds may be made to a p atron or guest of\nsuch state park of any unearned money advanced or paid by such guest or patron.\nThe department may accept from a guest or patron an amount which includes the\nfee for the service rendered plus a gratuity for the waitress or other designate d\nperson and remit the gratuity directly from the depository or cash fund to the\ndesignated recipient thereof. Such funds or depositories shall be governed by\nregulations established by the Department of Parks and approved by the Finance\nand Administration Cabinet.\n(8) The commissioner may promulgate administrative regulations in accordance with\nprovisions of KRS Chapter 13A in order to carry out the provisions of this section.","path":["KRS Chapter 148"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57313","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:40Z","sha256":"40e3213c306e9c9b9e019a988cabf00973bfa67b2e81582bf684694f38fce3c9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-148.020","next":"us-ky/krs-148.0211"},"notice":"GroundRules: Original legal text.
