{"data":{"id":"us-ky/krs-148.0212","jurisdiction":"us-ky","citation":"KRS 148.0212","heading":"Permanently  and totally disabled resident veteran exempt  from","body":"overnight  accommodation  rate at Kentucky  state parks -- Maximum\nnumber  of stays -- Peak periods -- Administrative regulations.\n(1) A  Kentucky  resident shall be  exempt  from  the  relevant overnight\naccommodations  rate at any Kentucky state park if he or she is:\n(a) A  permanently and totally disabled veteran with a one hundred percent\n(100%) service-connected disability, regardless of wartime service; or\n(b) A  permanently and totally disabled member  of the Kentucky National\nGuard  or Reserve Component  injured while on state active duty, active\nduty training, or inactive duty training.\n(2) To  be entitled to the exemption under this section, a veteran must be a\nKentucky resident and must be rated one hundred percent (100%) permanently\nand totally disabled, as the result of an injury suffered while on active duty, by\nthe United States Department of Veterans Affairs or the Department of\nDefense. Members  of the Kentucky National Guard or Reserve Component\nmust be rated one hundred percent (100%) permanently and totally disabled as\nprovided in KRS Chapter 342.\n(3) The  exemption shall be made  available to qualified Kentucky residents as\ndescribed in this section for a maximum  of three (3) overnight stays per\ncalendar year at any Kentucky state park. Each stay shall be limited to a\nmaximum  of three (3) days, subject to availability. During peak periods, as\ndefined elsewhere in this section, stays are to be taken during the Sunday\nthrough Thursday five (5) day period only. Outside of peak periods, stays are\navailable at any time.\n(4) The  Department of Parks shall promulgate any administrative regulations\nnecessary to carry out this section, including but not limited to:\n(a) Defining peak periods, which shall be no longer than the days between\nMemorial Day and Labor Day and the month of October;\n(b) Establishing the ten (10) day window  during which reservations by\nresidents under this section may be made;\n(c) Establishing those accommodations which qualify for the exemption; and\n(d) Delineating the types of proof acceptable for establishing eligibility for\npersons entitled to the exemption provided for in this section, while\nworking in conjunction with the Kentucky Department of Veterans' Affairs.\n(5) The exemption described in this section shall not limit the benefits of a qualified\nKentucky resident if he or she is also eligible for benefits under KRS 148.0211.","path":["KRS Chapter 148"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45832","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:40Z","sha256":"78801fe18b0344ebd8e7c92bd46e57df04482700af5b7bbe0d97357dd3ebd2bc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-148.0211","next":"us-ky/krs-148.022"},"notice":"GroundRules: Original legal text.
