{"data":{"id":"us-ky/krs-148.121","jurisdiction":"us-ky","citation":"KRS 148.121","heading":"Condemnation of land designated by United States for parks -- Procedure.","body":"(1) The commission may condemn any land or any interest in land within areas\ndesignated by the United States for park sites. Condemnation proceedings shall be\nexercised in accordance with the Eminent Domain Act of Kentucky. No\ncondemnation proceedings shal l impose on the state any liability for which\nprovision has not previously been made. The commission shall also pay the\nexpenses of condemnation proceedings, judgments and awards in condemnation\nproceedings, and other expenses necessary to acquire property.\n(2) The action shall be brought in the Circuit Court where the property lies by the\nAttorney General, and the county attorney of that county at the direction of the\nAttorney General shall assist in the prosecution of said action.\n(3) It shall not be mand atory for the commission to take the property at the price fixed\nby the jury or court judgment. However, in case the commission does not take the\nproperty, and perform all requirements of the judgment rendered by the court, then\nand in that event said comm ission shall pay the property owner all expenses as he\nmay have incurred incident to the law suit, including attorney's fees, and the\nproperty owner may have judgment in the original action upon filing proper proof\nthereof with the court.","path":["KRS Chapter 148"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1711","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:40Z","sha256":"4f879d5a276a66e412a4bf952ebef04dde538d9b7b10d3445d9c166cd582d612","source_id":"us-ky","stale":false,"prev":"us-ky/krs-148.120","next":"us-ky/krs-148.130"},"notice":"GroundRules: Original legal text.
