{"data":{"id":"us-ky/krs-148.650","jurisdiction":"us-ky","citation":"KRS 148.650","heading":"Establishment and designation of trails.","body":"(1) State scenic trails shall be established and designated by the department on lands\nadministered by the department and on lands under the jurisdiction of a state\ndepartment, political subdivision, or private lands providing:\n(a) Such trails are not located  in nor traverse any state -owned wildlife\nmanagement area; and\n(b) Such trails meet the criteria established in KRS 148.610 to 148.780 and\nsupplementary criteria as may be prescribed by the department.\n(2) The department may establish and designate state  recreation trails on lands\nadministered by the department and on lands under the jurisdiction of a state\ndepartment, political subdivision, or private lands providing:\n(a) Such trails are not located in nor traverse any state -owned wildlife\nmanagement area;\n(b) Such trails are reasonably accessible to urban areas;\n(c) Such trails meet the criteria established in KRS 148.610 to 148.780 and\nsupplementary criteria as may be prescribed by the department; and\n(d) Fee simple, scenic easements, or other right s are obtained from private\nlandowners through which a state recreation trail may pass. The department\nmay establish and designate state recreation trails on lands under the\njurisdiction of a federal agency, when in the opinion of the federal agency and\nthe commissioner such lands may be so developed under the provisions of\nfederal law and the provisions of paragraphs (b) and (c) of this subsection.\n(3) As provided in this section, trails within park, forest, recreation areas, state natural\nareas, or any o ther public area excluding state -owned wildlife management areas\nmay be established and designated state recreation trails by the department.\n(4) Connecting or side trails within park, forest, recreation areas, or natural areas may\nbe established, designated, and marked as components of a state recreation or state\nscenic trail.","path":["KRS Chapter 148"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1779","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:41Z","sha256":"f60843aa0f174f9d43deb8f00967ddab5b489cb8b5c0ccb12fdc091537de0a57","source_id":"us-ky","stale":false,"prev":"us-ky/krs-148.640","next":"us-ky/krs-148.660"},"notice":"GroundRules: Original legal text.
