{"data":{"id":"us-ky/krs-148.810","jurisdiction":"us-ky","citation":"KRS 148.810","heading":"Use of moneys in fund.","body":"(1) Funds in the park capital maintenance and renovation fund shall be used for the\nmaintenance and renovation of park facilities. Maintenance shall include equipment\npurchases, used primarily in the maintenance of infrastructure and park facilities,\nand expenditures related to preventative maintenance of capital assets. Renovation\nincludes the replacement of depreciable assets, including furnishings, and purchase\nof depreciable assets which enhance the quality of the parks.\n(2) In no case shall the moneys from the fund be expended on:\n(a) New capital project construction;\n(b) Any new maintenance or renovation project estimated to cost four hundred\nthousand dollars ($400,000) or more in cash or other consideration; or\n(c) Any new item of equipment estimated to c ost one hundred thousand dollars\n($100,000) or more in cash or other consideration.\n(3) Moneys in the park capital maintenance and renovation fund may be used to\nprovide additional funding for any capital project, as defined in KRS 45.750, that\nreceived li ne item authorization from the General Assembly in any executive\nbranch budget bill only if the state budget director or the director's designee submits\nthe proposed allocation to the Capital Projects and Bond Oversight Committee at\nleast fourteen (14) day s prior to the committee meeting, in accordance with the\nprovisions of KRS 45.800.\n(4) Notwithstanding the provisions of KRS 45.760(6), moneys in the park capital\nmaintenance and renovation fund shall not be used to provide additional funding for\nany capital project, as defined in KRS 45.750, that received line item authorization\nfrom the General Assembly in any executive branch budget bill, and that has\nalready received maximum additional funding as permitted by KRS 45.760(6)\nunless the state budget direct or or the director's designee submits the proposed\nallocation to the Capital Projects and Bond Oversight Committee at least fourteen\n(14) days prior to the committee meeting, in accordance with the provisions of KRS\n45.800. In addition to the requirements of KRS 45.800, the submission shall include\na written certification that:\n(a) Due to extraordinary circumstances, which shall be described, additional\nfunds are necessary for the project to be completed in a manner that will allow\nit to serve its intended purpose; and\n(b) The use of funds from the parks capital maintenance and renovation fund do\nnot unduly compromise the routine maintenance and renovation needs that the\nfund was created to address.\n(5) The commissioner shall, by September 1 of each year, re port to the Legislative\nResearch Commission the receipts, expenditures, and any amounts carried forward\nfor the fiscal year ending on June 30 of that year from the fund established in KRS\n148.800.","path":["KRS Chapter 148"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1799","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:41Z","sha256":"081d85ed00706c1e1ad432bb472605c1a6f5970aecbeb9c6b32c13c75e3671fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-148.805","next":"us-ky/krs-148.815"},"notice":"GroundRules: Original legal text.
