{"data":{"id":"us-ky/krs-148.876","jurisdiction":"us-ky","citation":"KRS 148.876","heading":"Acquisition of land.","body":"(1) The power of eminent domain may only be exercised to acquire land in fee within\nthe boundaries of the trail, except that the power of eminent domain shall not be\nexercised to acquire any privately owned dwelling, areas designated for residential\nstructures and their surrounding properties, or property owned or leased, including\nadjacent or contiguous tracts of land leased or owned or which may be acquired, for\nthe purposes of operating an oil or gas well, surface or underground coal mine\noperation, or surfa ce or underground mineral quarrying operation, if the person\nholds a state permit or license issued by the Energy and Environment Cabinet,\nDivision of Mine Permits or Division of Mine Safety.\n(2) Within the boundaries of the trail, the department may acqui re, on behalf of the\nCommonwealth, fee title or lesser interests in land. Acquisition of land may be by\ngift, by purchase with donated funds, by funds appropriated by the General\nAssembly, by the use of proceeds from the sale of bonds, by exchange, by\nassumption of property tax payments, or by other authorized means.\nNotwithstanding the provisions in KRS 350.085(3) and 353.610, in acquiring any\ninterests the Commonwealth or its agencies shall waive the three hundred (300) foot\nrestriction contained in KRS 3 50.085(3) and boundary restrictions for a well set\nforth in KRS 353.610.","path":["KRS Chapter 148"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44520","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:42Z","sha256":"97c82f4cbf24d9ec0b283a8caa4298873368fc3b673e67680bd28dfa29d52c68","source_id":"us-ky","stale":false,"prev":"us-ky/krs-148.874","next":"us-ky/krs-148.878"},"notice":"GroundRules: Original legal text.
