{"data":{"id":"us-ky/krs-149.330","jurisdiction":"us-ky","citation":"KRS 149.330","heading":"Definitions for KRS 149.330 to 149.355.","body":"As used in KRS 149.330 to 149.355, unless the context requires otherwise:\n(1) \"Best management practices\" means effective, practical, economical, structural, or\nnonstructural methods that prevent or reduce the movement of sediment, nutrients,\npesticides, a nd other pollutants from the land to surface or groundwater, or that\notherwise protect water quality from potential adverse effects of timber harvesting\noperations as developed by the Division of Forestry and approved by the\nAgriculture Water Quality Authority;\n(2) \"Cabinet\" means the Energy and Environment Cabinet;\n(3) \"Director\" means the director of the Division of Forestry;\n(4) \"Division\" means the Division of Forestry;\n(5) \"Logger\" means any person who conducts timber harvesting operations for\ncommercial purposes;\n(6) \"Operator\" means any person who operates or exercises control over any timber\nharvesting operations;\n(7) \"Person\" means any natural person or any director, officer, or agent of a partnership,\ncorporation, association, society, joint stock company, firm, company, or business\norganization. \"Person\" also means any agency or instrumentality of federal, state, or\nlocal government, including any publicly -owned utility or any publicly -owned\ncorporation of federal, state, or local government;\n(8) \"Timber harvesting operations\" means activities directly related to the cutting or\nremoval of trees from the forest as a raw material for commercial processes or\npurposes, including timber preharvesting and postharvesting activities associated\nwith the impl ementation of appropriate best management practices. \"Timber\nharvesting operations\" does not include:\n(a) The cutting of firewood;\n(b) The cutting of evergreens grown for and cut for the traditional Christmas\nholiday season;\n(c) The removal of trees incidental to clearing for coal mining or farm purposes or\nincidental to ground -disturbing construction activities, including well sites,\nand access roads and gathering lines for oil and natural gas operations;\n(d) The cutting of trees for maintaining existing, or during construction of, rights-\nof-way for public highways or public utilities, unless those trees are being sold\nor provided as raw material for commercial wood product purposes; or\n(e) The cutting of trees by an individual, nonindustrial landowner on his own\nproperty, if the cutting is performed by the individual, nonindustrial\nlandowner; and\n(9) \"Water pollution\" has the same meaning as in KRS 224.1-010.","path":["KRS Chapter 149"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44395","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:42Z","sha256":"b6e35f89e97b840095f89fa0cdb22894477fd3052679668ed1181afc6e6425f0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-149.325","next":"us-ky/krs-149.332"},"notice":"GroundRules: Original legal text.
