{"data":{"id":"us-ky/krs-149.400","jurisdiction":"us-ky","citation":"KRS 149.400","heading":"Fire hazard seasons -- Fires prohibited -- Exceptions.","body":"(1) The periods commencing on February 15 and ending on April 30 and commencing\non October 1 and ending on December 15 of each year are hereby declared to be and\nestablished as the fire hazard seasons. During the fire hazard seasons, even though\nthe precautions required by KRS 149.375 shall have been taken, it shall be unlawful\nfor any person to set fire to, or to procure another to set fire to, any flammable\nmaterial capable of spreading fire, located in or within one hundred fifty feet (150')\nof any woodland or brushland, except between the hours of 6:00 p.m. and 6:00 a.m.,\nprevailing local time, or when the ground is covered with snow.\n(2) This section shall not apply to fires which may be set for the purpose of burning\nplant beds.\n(3) This section shall not apply to fires which may be set by competent and qualified\nemployees of railroad, utility, or pipeline companies in connection with the\nconstruction, operation, or maintenance of railroads, pipelines, powerlines, or other\nprojects in the public interest on  rights-of-way used for such railroads, pipelines,\npowerlines, or other projects, and such fires shall be attended at all times and be\nextinguished before the employees of such railroad, utility, or pipeline companies\nleave the vicinity of the fire.\n(4) This section shall not apply to fires set by trained and qualified employees of a state\ngovernment agency on land owned by the state or leased or managed by the state\nunder a written agreement with the landowner and set for the specific purpose of\nwildlife o r plant habitat improvement, ecological site restoration, site preparation\nfor natural or artificial regeneration or fuel reduction. Nongovernmental\norganizations and other governmental agencies may apply to the Division of\nForestry for written approval to  set fires under this subsection. Fires set under this\nsubsection shall be in accordance with KRS 149.375. Persons who set such fires\nshall give written notification of the burn to the local Division of Forestry district\noffice at least twenty -four (24) ho urs in advance and obtain the approval of the\ndistrict office.","path":["KRS Chapter 149"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1898","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:42Z","sha256":"38bf95799f44082f7413909460bdcfad48f9bafcca507cf0fa328527350546b7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-149.395","next":"us-ky/krs-149.401"},"notice":"GroundRules: Original legal text.
