{"data":{"id":"us-ky/krs-149.401","jurisdiction":"us-ky","citation":"KRS 149.401","heading":"City or county ordinance banning open burning during fire hazard","body":"periods.\n(1) Without limiting the general authority granted to a county by KRS 67.083 and the\ngeneral authority granted to a city by KRS 82.082, a city or county may enact an\nordinance banning all open burning during periods of extraordinary forest fire\nhazard or f ire occurrence. Such ordinance may authorize the implementation of\nsuch a ban by executive order of the chief executive officer upon notice by the\nDivision of Forestry that a period of extraordinary forest fire hazard or fire\noccurrence exists.\n(2) Any ordinance promulgated by a city or county pursuant to subsection (1) of this\nsection may establish penalties for violation of the ordinance not to exceed the\npenalties set forth in KRS 149.990(2).\n(3) Any ordinance promulgated by a city or county pursuant to subsection (1) of this\nsection may be enforced by the promulgating body, or by the cabinet, and referred\nto the appropriate county or Commonwealth attorney for prosecution.","path":["KRS Chapter 149"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1899","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:42Z","sha256":"6fb907bdafb998bc30a17c4b416cf2dc6990f71d58089e4c65746fcd2a805449","source_id":"us-ky","stale":false,"prev":"us-ky/krs-149.400","next":"us-ky/krs-149.405"},"notice":"GroundRules: Original legal text.
