{"data":{"id":"us-ky/krs-14a.2-100","jurisdiction":"us-ky","citation":"KRS 14A.2-100","heading":"Filing duty of Secretary of State.","body":"(1) If a document delivered to the office of the Secretary of State for filing satisfies the\nrequirements of this chapter and applicable organic law, the Secretary of State shall\nfile it.\n(2) The Secretary of State files a document by recording it as filed as provided in KRS\n14A.2-070(1)(a).\n(3) After filing a document, the Secretary of State shall deliver to the entity or foreign\nentity or to the person delivering the document for filing or to another person as\nidentified in writing a copy of the document with  an acknowledgment of the time\nand date of filing.\n(4) If the Secretary of State refuses to file a document, the Secretary of State shall\nreturn it to the filer within five (5) days after the document was delivered, together\nwith a brief, written explanation of the reason for the refusal.\n(5) The Secretary of State's delivery of an acknowledgment of filing, an explanation for\nthe reason a document was not filed, or other communication as to a document filed\nor delivered for filing may be accomplished electronically.\n(6) The Secretary of State's duty to file documents under this section shall be\nministerial. The filing or refusal to file a document shall not:\n(a) Affect the validity or invalidity of the document in whole or part;\n(b) Relate to the correctness  or incorrectness of information contained in the\ndocument; or\n(c) Create a presumption that the document is valid or invalid or that information\ncontained in the document is correct or incorrect.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36536","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:32Z","sha256":"aa4a96b761061d80c6aeb22631d0c0d1bd9746ac62c8cceb241edfcad2af7978","source_id":"us-ky","stale":false,"prev":"us-ky/krs-14a.2-090","next":"us-ky/krs-14a.2-110"},"notice":"GroundRules: Original legal text.
