{"data":{"id":"us-ky/krs-14a.3-040","jurisdiction":"us-ky","citation":"KRS 14A.3-040","heading":"Name of foreign entity.","body":"(1) If the real name of a foreign entity does not satisfy the requirements of KRS 14A.3 -\n010 as would apply were the foreign entity organized in this Commonwealth, the\nforeign entity seeking to obtain or maintain a certificate of authority to transact\nbusiness in this Commonwealth:\n(a) May use a fictitious name to transact business in this Commonwealth if its\nreal name is not distinguishable from any name of record with the Secretary of\nState; or\n(b) May supplement its name with such identifier as would be appro priate under\nKRS 14A.3-010 were the foreign entity organized in this Commonwealth.\n(2) The real or fictitious name of a foreign entity shall be distinguishable upon the\nrecords of the Secretary of State from any name of record with the Secretary of\nState.\n(3) If a foreign entity authorized to transact business in this Commonwealth changes its\nreal name to one that does not satisfy the requirements of KRS 14A.3 -010, it shall\nnot transact business in this Commonwealth under the changed name until it adopts\na fictitious name satisfying the requirements of KRS 14A.3 -010 and obtains an\namended certificate of authority in accordance with KRS 14A.9-040.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41106","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:32Z","sha256":"de021f938d52da2c5a3c501e060cd13af542b0dbbbec87527c6bf920e4a3a45e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-14a.3-030","next":"us-ky/krs-14a.3-050"},"notice":"GroundRules: Original legal text.
