{"data":{"id":"us-ky/krs-15.020","jurisdiction":"us-ky","citation":"KRS 15.020","heading":"Chief law officer and adviser -- Duty to attend to litigation, write opinions,","body":"draft writings -- Communication with Legislative Research Commission --\nWhen to appear for Commonwealth -- Constitutional challenge may be\nbrought in any county.\n(1) The Attorney General is the chief law officer of the Commonwealth of Kentucky\nand all of its departments, commissions, agencies, and political subdivisions, and\nthe legal adviser of all state officers, departments, commissions, and agencies, and\nwhen requested in writing shall furnish to them his or her written opinion touching\nany of their official duties, and shall prepare proper drafts of all instruments of\nwriting required for public use, and shall exercise all common law duties and\nauthority pertaining to the office of the Attorney General under the common law,\nexcept when modified by statutory enactment.\n(2) The Attorney General shall communicate with the Legislative Research\nCommission as required by KRS 418.075.\n(3) Except as otherwise provided in KRS 48.005 and 2000 Ky. Acts ch. 483, sec. 8, the\nAttorney General shall appear for the Commonwealth in all cases in the Supreme\nCourt or Court of Appeals wherein the Commonwealth is interested, and shall also\ncommence all actions or enter an appearance in  all cases, hearings, and proceedings\nin and before all other courts, tribunals, or commissions in or out of the state, and\nattend to all litigation and legal business in or out of the state required of the office\nby law, or in which the Commonwealth has a n interest, and any litigation or legal\nbusiness that any state officer, department, commission, or agency may have in\nconnection with, or growing out of, his, her, or its official duties, except where it is\nmade the duty of the Commonwealth's attorney or county attorney to represent the\nCommonwealth. When any attorney is employed for any said agency, the same shall\nhave the approval of such agency before such employment.\n(4) Notwithstanding any other statute or provision to the contrary, the Attorney General\nmay bring any action challenging the constitutionality of a Kentucky statute,\nexecutive order, administrative regulation, or order of any cabinet, program cabinet,\nor department under KRS Chapter 12. The action may be brought in any county\nwhere the all eged constitutional harm has occurred or could be reasonably\npresumed to occur.\n(5) If any funds of any kind or nature whatsoever are recovered by or on behalf of the\nCommonwealth, in any action, including an ex rel. action where the Attorney\nGeneral has e ntered an appearance or is a party according to statutory or common\nlaw authority, those funds shall be handled under KRS 48.005.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51423","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:32Z","sha256":"61b619a5b4301c82bad34bcf6e1c7521bbe1196071e94911ad66615ab3222213","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.015","next":"us-ky/krs-15.025"},"notice":"GroundRules: Original legal text.
