{"data":{"id":"us-ky/krs-15.243","jurisdiction":"us-ky","citation":"KRS 15.243","heading":"Enforcement of all election laws -- Duties of Attorney General -- Toll-free","body":"line for report of violations -- Random inquiry for irregularities -- Initiation of\nprosecutions.\n(1) In addition to the other duties and powers of the Attorney Genera l, he or she shall\nenforce all of the state's election laws by civil or criminal processes.\n(2) The Attorney General shall:\n(a) Devise and administer programs to observe the conduct of elections;\n(b) Hold public hearings;\n(c) Establish a toll -free telephone service for the purpose of receiving reports of\nelection law violations. The service shall be operated during regular business\nhours throughout the year and during the hours which any poll in the state is\nopen on the day of any primary, special election, or regular election;\n(d) Initiate investigations or investigate alleged violations of election laws at the\nrequest of a registered voter or on his or her own motion;\n(e) Issue subpoenas for the production of any books, papers, correspondence,\nmemoranda or other records, and compel the attendance of witnesses that he\nor she deems relevant to the purposes of any investigation;\n(f) Present evidence of alleged violations to a grand jury; and\n(g) File appropriate complaints in any court of competent jurisdiction.\n(3) (a) The Attorney General shall be required to begin an independent inquiry for\nany potential irregularities that may have occurred in each election in not\nfewer than twelve (12) of Kentucky's counties, to be selected at random in a\npublic process, w ithin twenty (20) days following each primary or regular\nelection.\n(b) The Attorney General shall promulgate administrative regulations in\naccordance with KRS Chapter 13A to establish a uniform procedure and\ntimeline for his or her agents to follow when conducting the independent\ninquiries. The administrative regulations shal l also designate the data and\nforms that shall be requested from each county that is chosen.\n(c) The Attorney General shall report his or her findings to the grand jury of each\ncounty involved, the chief circuit judge for the circuit in which the county is\nlocated, and the appropriate county clerk.\n(4) When the Registry of Election Finance concludes there is probable cause to believe\na violation of election laws has occurred, it shall forward the matter to the Attorney\nGeneral for prosecution. In the event the Attorney General or local prosecutor fails\nto prosecute the matter in a timely fashion, the registry's attorney may petition the\nCircuit Court to be appointed as a special prosecutor. Upon such motion timely\nfiled, for good cause shown, the court shall enter an order to that effect.\n(5) When requested by the Attorney General, all state and local agencies and officials,\nincluding the Auditor of Public Accounts, Commonwealth's attorneys, county\nattorneys, Registry of Election Finance, Department of Kentuc ky State Police,\nsheriffs' departments and local police shall give all possible assistance to the\nAttorney General in the performance of his or her duties.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53817","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:33Z","sha256":"b32d32043c9b0857ffc0c4ccd3168ea241f9d29bf05d39e43e1247685bafcd9c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.242","next":"us-ky/krs-15.245"},"notice":"GroundRules: Original legal text.
