{"data":{"id":"us-ky/krs-15.300","jurisdiction":"us-ky","citation":"KRS 15.300","heading":"Tobacco Master Settlement Agreement Compliance Advisory Board --","body":"Members -- Organization -- Duties -- Duties of Attorney General.\n(1) As used in this section, \"consent order\" means the consent order of December 21,\n1998, agreed to in Commonwealth of Ke ntucky v. Philip Morris Inc. et al., Docket\nNumber 98-CI-01579, Franklin Circuit Court.\n(2) There is created the Tobacco Master Settlement Agreement Compliance Advisory\nBoard in the Department of Law. The board shall be composed of six (6) members\nas follows:\n(a) The Attorney General, or the Attorney General's designee;\n(b) The secretary of the Cabinet for Health and Family Services, or the secretary's\ndesignee;\n(c) The Commissioner of Agriculture, or the Commissioner's designee;\n(d) The secretary of the Public Protection Cabinet, or the secretary's designee; and\n(e) Two (2) citizens at large appointed by the Attorney General.\n(3) The citizen members of the board shall serve for terms of one (1) year and until\ntheir successors are appointed. The citizen memb ers shall be eligible for successive\nterms on the board.\n(4) The board shall annually elect a member to serve as its chair and shall meet at least\nquarterly on a date set by the board. Board members shall be reimbursed for\nnecessary expenses incurred in serving on the board.\n(5) The board may adopt rules governing the conduct of its meetings, the creation of\nmeeting agendas, and other procedural matters it deems necessary. The board may\nadopt reporting forms, which shall be developed in consultation with pa rticipating\nagencies.\n(6) The Office of the Attorney General shall:\n(a) Enter into a memorandum of agreement with the Department of Public Health\nof the Cabinet for Health and Family Services, the Department of Alcoholic\nBeverage Control in the Public Prot ection Cabinet, and the Department of\nAgriculture to identify and report possible violations of the consent order;\n(b) Attempt to secure funding under the master settlement agreement to reimburse\nthe agencies specified in paragraph (a) of this subsection f or any compliance\nactivity that they perform; and\n(c) Provide necessary funding and staff for administrative expenses related to the\noperation of the board. The board may request assistance from other state\nagencies.\n(7) The Tobacco Master Settlement Agreement Compliance Advisory Board shall:\n(a) Identify activities for which training is required for personnel of the state\nagencies specified in paragraph (a) of subsection (6) of this section that are\nresponsible for identi fying and reporting possible violations of the consent\norder;\n(b) Determine eligible compliance training costs and seek reimbursement for the\ncosts; and\n(c) Notify the appropriate tobacco manufacturer, in writing, of any alleged\nviolation of the consent or der and request a response and, if applicable, a\ncorrective action plan within thirty (30) days from the date of the notice. If the\nmanufacturer fails to respond or to satisfactorily resolve the matter, the board\nshall review the matter at its next meeting  and may refer the matter to the\nOffice of the Attorney General for enforcement action, if warranted.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=919","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:33Z","sha256":"d5d6f1a78828be58024663fc76797ae5d139ea275586e94225d78880f701149c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.295","next":"us-ky/krs-15.310"},"notice":"GroundRules: Original legal text.
