{"data":{"id":"us-ky/krs-15.334","jurisdiction":"us-ky","citation":"KRS 15.334","heading":"Mandatory training subjects for law enforcement students -- Mandatory in-","body":"service training courses for certified peace officers -- Administrative\nregulations -- Sexual assault investigation training course -- Domestic violence\nand abuse training.\n(1) The Kentucky Law Enforcement Council shall approve mandatory training subjects\nto be taught to all students attending a law enforcement basic training course that\ninclude but are not limited to:\n(a) Abuse, neglect, and exploitation of the elderly and other crimes against the\nelderly, including the use of multidisciplinary teams in the investigation and\nprosecution of crimes against the elderly;\n(b) The dynamics of domestic violence, pediatric abusive head trauma, as defined\nin KRS 620.020, child ph ysical and sexual abuse, and rape; child\ndevelopment; the effects of abuse and crime on adult and child victims,\nincluding the impact of abuse and violence on child development; legal\nremedies for protection; lethality and risk issues; profiles of offender s and\noffender treatment; model protocols for addressing domestic violence, rape,\npediatric abusive head trauma, as defined in KRS 620.020, and child abuse;\navailable community resources and victim services; and reporting\nrequirements. This training shall be developed in consultation with legal,\nvictim services, victim advocacy, and mental health professionals with\nexpertise in domestic violence, child abuse, and rape. Training in recognizing\npediatric abusive head trauma may be designed in collaboration wi th\norganizations and agencies that specialize in the prevention and recognition of\npediatric abusive head trauma approved by the secretary of the Cabinet for\nHealth and Family Services;\n(c) Human immunodeficiency virus infection and acquired immunodeficien cy\nvirus syndrome;\n(d) Identification and investigation of, responding to, and reporting bias -related\ncrime, victimization, or intimidation that is a result of or reasonably related to\nrace, color, religion, sex, or national origin;\n(e) The characteristics and dynamics of human trafficking, state and federal laws\nrelating to human trafficking, the investigation of cases involving human\ntrafficking, including but not limited to screening for human trafficking, and\nresources for assistance to the victims of human trafficking;\n(f) At least eight (8) hours of training relevant to sexual assault;\n(g) Education on female genital mutilation as defined in KRS 508.125, including\nthe risk factors associated with female genital mutilation, the criminal\npenalties for committing female genital mutilation, and the psychological and\nhealth effects on a victim of female genital mutilation; and\n(h) The characteristics, dynamics, and investigation of pediatric ingestion or\ninhalation of controlled substances.\n(2) (a) The council shall develop and approve mandatory in -service training courses\nto be presented to all certified peace officers. The council may promulgate\nadministrative regulations in accordance with KRS Chapter 13A setting forth\nthe deadlines by which all certified peace officers shall attend the mandatory\nin-service training courses.\n(b) The council shall establish a forty (40) hour sexual assault investigation\ntraining course. Agencies shall maintain officers on staff who have completed\nthe forty (40) hour sexual assault investigation training course in accordance\nwith the following:\n1. Agencies with more than ten (10) but fewer than twenty -one (21) full -\ntime officers shall maintain one (1) officer who has completed the forty\n(40) hour sexual assault investigation training course;\n2. Agencies with twenty -one (21) or more but fewer than fif ty-one (51)\nfull-time officers shall maintain at least two (2) officers who have\ncompleted the forty (40) hour sexual assault investigation training\ncourse; and\n3. Agencies with fifty-one (51) or more full -time officers shall maintain at\nleast four (4) off icers who have completed the sexual assault\ninvestigation course.\n(c) An agency shall not make an officer directly responsible for the investigation\nor processing of sexual assault offenses unless that officer has completed the\nforty (40) hour sexual assault investigation training course.\n(d) The council may, upon application by any agency, grant an exemption from\nthe training requirements set forth in paragraph (b) of this subsection if that\nagency, by limitations arising from its scope of authority, does not conduct\nsexual assault investigations.\n(e) Any agency failing to comply with paragraph (b) or (c) of this subsection\nshall, from the date the noncompliance commences, have one (1) year to\nreestablish the minimum number of trained officers required.\n(3) (a) The Justice and Public Safety Cabinet shall provide training on the subjects\nof:\n1. Domestic violence and abuse. All certified peace officers shall be\nrequired to complete this training at least once every two (2) years; and\n2. Pediatric ingestion or inhalation of controlled substances. All certified\npeace officers shall be required to complete this training at least once\nevery three (3) years.\n(b) Training required under paragraph (a) of this subsection may be completed\nutilizing currently available technology.\n(4) The council shall promulgate administrative regulations in accordance with KRS\nChapter 13A to establish mandatory basic training and in-service training courses.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57464","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:33Z","sha256":"5eee0f6096cc218826fce36167152cc3a9247b4816893b40a0a5aaf102d3b50e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.333","next":"us-ky/krs-15.335"},"notice":"GroundRules: Original legal text.
