{"data":{"id":"us-ky/krs-15.388","jurisdiction":"us-ky","citation":"KRS 15.388","heading":"Report on certification status for newly employed peace officer or court","body":"security officer -- Training of person in precertification status -- Issuance or\ndenial -- Right of appeal -- Transfer.\n(1) Within five (5) working days of employment or appointment, the chief executive\nofficer of the employing agency, or his designee, shall file a report with the council\ncertifying that the newly employed officer is certified or meets or exceeds the\nprecertification qualifications of KRS 15.382 for peace officers or KRS 15.3971 for\ncourt security officers.\n(2) If the person is certified, the council shall continue certified status.\n(3) If the person is on inactive status, the council shall upgrade to certified status unless\nthe certification is revoked or denied as provided by KRS 15.380 to 15.404.\n(4) If the person is not certified and not on inactive status, but has successfully\ncompleted an applicable basic training course or received a basic training credit\nunder KRS 15.440(1)(d)6. approved and recogniz ed by the council, the council\nshall designate the person as being in certified status unless the certification is\nrevoked or denied as provided by KRS 15.380 to 15.404.\n(5) If the person is not certified and not on inactive status, and has not successfull y\ncompleted an applicable basic training course approved and recognized by the\ncouncil, the council shall designate the person as being in precertification status.\n(6) A person who is in precertification status shall, upon successful completion of the\nrequired basic training, be certified unless he has committed an act that would result\nin revocation of his certificate in which case he shall be denied certification.\n(7) A person who is denied certified status under this section shall have the same right\nof appeal as a person who has been revoked under KRS 15.380 to 15.404.\n(8) If the certified peace officer has successfully completed the basic training required\nby KRS 15.404 and transfers from a peace officer or court security officer position\nfrom a current employer to a peace officer position for another employer, and both\nemployers have, at least ten (10) working days prior to the effective date of the\ntransfer, notified the council in writing of the transfer, the council shall maintain the\nofficer in certified status.\n(9) If the certified court security officer has successfully completed the basic training\nrequired by KRS 15.3975 and transfers from a court security officer position from a\ncurrent employer to a court security officer position for another em ployer, and both\nemployers have, at least ten (10) working days prior to the effective date of the\ntransfer, notified the council in writing of the transfer, the council shall maintain the\nofficer in certified status.\n(10) A certified court security office r who has met the requirements of KRS 15.3971\nshall not transfer from a court security officer position to a peace officer position\nunless the certified court security officer meets all the requirements of a certified\npeace officer under KRS 15.382 and 15.404(1). If the certified court security officer\nhas met the minimum qualifications of KRS 15.382, successfully completed the\nbasic training required for certified peace officers under KRS 15.404(1), and\ntransfers from a court security officer position from  a current employer to a peace\nofficer position for another employer, and both employers have, at least ten (10)\nworking days prior to the effective date of the transfer, notified the council in\nwriting of the transfer, the council shall maintain the officer in certified status.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51069","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:33Z","sha256":"5123a960fe0f8a7305d464823a6dc6222b08a413adc5a6a30e17d3faf7568b36","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.386","next":"us-ky/krs-15.390"},"notice":"GroundRules: Original legal text.
