{"data":{"id":"us-ky/krs-15.3971","jurisdiction":"us-ky","citation":"KRS 15.3971","heading":"Court security officers -- Minimum qualifications -- Exceptions.","body":"(1) A person certified as a court security officer after June 26, 2007, under KRS 15.380\nto 15.404 shall, at the time of becoming certified, meet the following minimum\nqualifications:\n(a) Be a citizen of the United States;\n(b) Be at least twenty-one (21) years of age;\n(c) 1. Be a high school graduate, regardless of whether the school is accredited\nor certified by a governing body, provided that the education received\nmet the atte ndance and curriculum standards of Kentucky law at the\ntime of graduation, as determined by the Kentucky Department of\nEducation; or\n2. Possess a high school diploma or a High School Equivalency Diploma;\n(d) Possess a valid license to operate a motor vehicle;\n(e) Be fingerprinted for a criminal background check;\n(f) Not have been convicted of any felony; a misdemeanor under KRS 510.120,\n510.130, or 510.140; a second or subsequent offense under KRS 510.148; or a\ncriminal attempt, conspiracy, facilitation, or solicitation to commit any degree\nof rape, sodomy, sexual abuse, or sexual misconduct; or have had any offense\nlisted under this paragraph expunged;\n(g) Not be prohibited by federal or state law from possessing a firearm;\n(h) Have received and read the Kentucky Law Enforcement Officers Code of\nEthics, as established by the council;\n(i) Have not received a dishonorable discharge, a bad conduct discharge, or\ngeneral discharge under other than honorable conditions if he or she served in\nany branch of the Armed Forces of the United States;\n(j) Have passed a drug screening test administered or approved by the council by\nadministrative regulation. A person shall be deemed to have passed a drug\nscreening test if the results of the test are negative for the use of an illegal\ncontrolled substance or prescription drug abuse. An y agency that administers\nits own test that meets or exceeds this standard shall certify passing test\nresults to the council, which shall accept them as complying with KRS 15.380\nto 15.404;\n(k) Have undergone a background investigation established or appro ved by the\ncouncil by administrative regulation to determine suitability for the position of\na court security officer. If the employing agency has established its own\nbackground investigation that meets or exceeds the standards of the council,\nas set forth  by administrative regulation, the agency shall conduct the\nbackground investigation and shall certify background investigation results to\nthe council, which shall accept them as complying with KRS 15.380 to\n15.404;\n(l) Have been interviewed by the employing agency;\n(m) Have taken a psychological suitability screening administered or approved by\nthe council by administrative regulation to determine the person's suitability\nto perform court security officer duties; and\n(n) Have taken a polygraph examination administered or approved by the council\nby administrative regulation to determine his or her suitability to perform\ncourt security officer duties. Any agency that administers its own polygraph\nexamination as approved by the council shall certify the result s that indicate\nwhether a person is suitable for employment as a court security officer to the\ncouncil, which shall accept them as complying with KRS 15.380 to 15.404.\n(2) A court security officer employed on or before June 26, 2007, shall comply with the\nrequirements of subsection (1) of this section within six (6) months of June 26,\n2007.\n(3) A peace officer who has previously attended law enforcement basic training and\nmet the certification requirements of KRS 15.380 and 15.382 shall not be required\nto meet the requirements of this section to be appointed a court security officer, but\nshall meet the requirements of KRS 15.386(3).","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54133","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:33Z","sha256":"0efafa207b2ffc28df1d1c40511b7086baf0ada65dd171357c01680c3cd7f4ff","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.396","next":"us-ky/krs-15.3973"},"notice":"GroundRules: Original legal text.
