{"data":{"id":"us-ky/krs-15.525","jurisdiction":"us-ky","citation":"KRS 15.525","heading":"Referral program for substance abuse treatment -- Information exempt","body":"from disclosure under KRS 61.878(1)(a) -- Limitation of liability.\n(1) A law enforcement agency may create a program to refer persons to treatment for\nsubstance use who voluntarily seek assistance from the law enforcement agency.\n(2) A person voluntarily seeking assistance through a program created pursuant to this\nsection:\n(a) Shall not be placed under arrest;\n(b) Shall not be prosecuted for the possession of any controlled sub stance or drug\nparaphernalia surrendered to the law enforcement agency. Items surrendered\npursuant to this paragraph shall be recorded by the law enforcement agency at\nthe time of surrender and shall be destroyed; and\n(c) Shall be promptly referred to a co mmunity mental health center, medical\nprovider, or other entity for substance use treatment.\n(3) A person is ineligible for placement through a program established pursuant to this\nsection if the person:\n(a) Has an outstanding arrest warrant issued by a Ke ntucky court or an\nextraditable arrest warrant issued by a court of another state;\n(b) Places law enforcement or its representatives in reasonable apprehension of\nphysical injury; or\n(c) Is under the age of eighteen (18) and does not have the consent of a parent or\nguardian.\n(4) Information gathered by a program created pursuant to this section related to a\nperson who has voluntarily sought assistance under this section is exempt from\ndisclosure under the Kentucky Open Records Act pursuant to KRS 61.878(1)(a).\n(5) Except for intentional misconduct, any law enforcement agency or person that\nprovides referrals or services in accordance with subsection (2) of this section shall\nbe immune from criminal and civil liability.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48801","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:34Z","sha256":"69fee4ac09d568686e31048d98b10585bdd24e9d3254af9d7cfefc7ac3d5435b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.520","next":"us-ky/krs-15.530"},"notice":"GroundRules: Original legal text.
