{"data":{"id":"us-ky/krs-15.540","jurisdiction":"us-ky","citation":"KRS 15.540","heading":"Qualifications for public safety telecommunicator -- Information not subject","body":"to disclosure -- Training requirements.\n(1) An agency seeking to hire a telecommunicator shall certify to the Kentucky Law\nEnforcement Council within one hundred twen ty (120) days after the hire date that\nthe applicant:\n(a) Is a citizen of the United States and has reached the age of majority;\n(b) 1. Is a high school graduate, regardless of whether the school is accredited\nor certified by a governing body, provided tha t the education received\nmet the attendance and curriculum standards of Kentucky law at the\ntime of graduation, as determined by the Kentucky Department of\nEducation; or\n2. Possesses a High School Equivalency Diploma;\n(c) Has not been convicted of a felony  or other crimes involving moral turpitude\nas determined by submission of each applicant's fingerprints to the\ninformation systems section of the Department of Kentucky State Police and\nto the Federal Bureau of Investigation identification division, and by  such\nother investigations as required by the hiring agency;\n(d) Has taken a psychological suitability screening administered or approved by\nthe Kentucky Law Enforcement Council to determine his or her suitability to\nperform the duties of a telecommunicato r. Any agency that administers its\nown suitability screening shall certify the results to the department;\n(e) Has taken a polygraph examination administered or approved by the\nKentucky Law Enforcement Council to determine his or her suitability to\nperform the duties of a telecommunicator. Any agency that administers its\nown polygraph examination shall certify the results to the department; and\n(f) Has passed a drug screening administered or approved by the Kentucky Law\nEnforcement Council. A person shall be deemed to have passed a drug\nscreening if the results are negative for the use of an illegal controlled\nsubstance or prescription drug abuse. An y agency that administers its own\nscreening shall certify passing results to the department.\n(2) Provisions of the Open Records Act, KRS 61.870 to 61.884, to the contrary\nnotwithstanding, the applicant's home address, telephone number, date of birth,\nSocial Security number, and results of any background investigation, psychological\nsuitability screening, and polygraph examination conducted under this section shall\nnot be subject to disclosure.\n(3) An agency that provides CJIS data using a CJIS terminal to l aw enforcement\nagencies and is seeking to hire a telecommunicator after July 15, 2024, shall certify\nthe applicant through the CJIS online training program before the applicant can\ndeliver CJIS data to law enforcement.\n(4) An agency that does not have a CJ IS terminal but receives CJIS data from an\nagency holding its originating agency identifier shall complete the CJIS security\nand privacy training before the applicant can deliver CJIS data to law enforcement.\n(5) If a public safety telecommunicator's only function is a call -taker at an agency that\nhas a CJIS terminal, the telecommunicator shall not be required to complete the\nCJIS online program but shall complete the CJIS security and privacy training.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55015","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:34Z","sha256":"e661640742dda8cbd8769ba62bfcd4069141336a3205a4b38c762a683c738f54","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.530","next":"us-ky/krs-15.550"},"notice":"GroundRules: Original legal text.
