{"data":{"id":"us-ky/krs-15.620","jurisdiction":"us-ky","citation":"KRS 15.620","heading":"Eliminating conflicts among standards.","body":"(1) Effective January 1, 1977, no inspecting agency shall employ in its inspections any\nstandard that conflicts with any other standard it employs in the same inspection or\nwith standards employed by another inspecting agency or by the federal\ngovernment.\n(2) Inspecting agencies with conflicting standards may enter into agreements among\nthemselves and with the federal government to eliminate conflicts among their\nstandards. All such agreements shall be in writing and shall be filed with the\nAttorney General.\n(3) If inspecting agencies with conflicting standards cannot agree among themselves or\nwith the federal government on the method for eliminating conflicts among\nstandards, they shall immediately refer the issue to the Attorney General. The\nAttorney General s hall determine the method for resolving the conflict subject to\nthe following requirements:\n(a) No inspecting agency shall employ a standard that conflicts with a standard\nemployed by the federal government;\n(b) No local governmental inspecting agency shal l employ a standard that\nconflicts with a standard employed by an inspecting agency of the state\ngovernment;\n(c) No city inspecting agency shall employ a standard that conflicts with a\nstandard employed by an inspecting agency of the county in which it is\nlocated; and\n(d) If two (2) or more inspecting agencies of the same level or unit of government\nhave conflicting standards, only the standard of the inspecting agency with\nprimary jurisdiction over the condition governed by the standard, as\ndetermined unde r KRS 15.610, shall be employed, unless the inspecting\nagency with primary jurisdiction is prohibited from employing the standard by\nparagraph (a), (b), or (c) of this subsection.\n(4) In determining the method for eliminating conflicts among standards unde r\nsubsection (3) of this section, the Attorney General shall select the method that he\ndetermines will best protect the public health, safety and welfare.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=979","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:34Z","sha256":"c7f49daaee56a6e8afbff06f13b1cd6d65918dfe07d1ba6c7905ea50c68710ab","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.615","next":"us-ky/krs-15.625"},"notice":"GroundRules: Original legal text.
