{"data":{"id":"us-ky/krs-15.725","jurisdiction":"us-ky","citation":"KRS 15.725","heading":"Duties of Commonwealth's attorney and county attorneys -- Agreements to","body":"share or redistribute prosecutorial duties -- Circuit clerk's authority to issue\ncriminal warrants.\n(1) The Commonwealth's attorney shall attend each Circuit Court held in his judi cial\ncircuit. He shall, except as provided in KRS 15.715 and KRS Chapter 131, have the\nduty to prosecute all violations whether by adults or by juveniles subject to the\njurisdiction of the Circuit Court of the criminal and penal laws which are to be tried\nin the Circuit Court in his judicial circuit. In addition, he shall have the primary\nresponsibility within his judicial circuit to present evidence to the grand jury\nconcerning such violations.\n(2) The county attorney shall attend the District Court in his  county and prosecute all\nviolations whether by adults or by juveniles subject to the jurisdiction of the regular\nor juvenile session of the District Court of criminal and penal laws, except as\nprovided in KRS Chapter 131, within the jurisdiction of said District Court.\n(3) The Commonwealth's attorney and county attorneys in a judicial circuit shall\ncooperate in the enforcement of criminal and penal laws of the Commonwealth.\nWhen necessary, the Commonwealth's attorney and county attorney shall assist each\nother in prosecution within their respective courts. Each Commonwealth's attorney\nand county attorney may enter into agreements to share or redistribute prosecutorial\nduties in the Circuit and District Courts. Any prosecutorial or related duty assigned\nby s tatute to the Commonwealth's attorney may be performed by the county\nattorney, and any prosecutorial or related duty assigned by statute to the county\nattorney may be performed by the Commonwealth's attorney pursuant to these\nagreements. Copies of the agre ements shall when executed be forwarded to the\nAttorney General, the chief judges of the Circuit and District Courts, and the chief\nregional judges of the Circuit and District Courts.\n(4) The Prosecutors Advisory Council shall in allocating resources betwe en the\nCommonwealth's and county attorney take the agreements into account.\n(5) In the event of the absence from a county of all District Judges and all Circuit\nJudges and all trial commissioners, the circuit clerk in each county may issue\ncriminal warrant s prepared by the Commonwealth's attorney or county attorney,\nwho shall certify that there is no District Judge, Circuit Judge, or trial commissioner\nwithin the county.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=993","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:34Z","sha256":"bb24dc207a05591fa3c3afd5c97c219adbd9db126feb19a1f9bd25690522a593","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.720","next":"us-ky/krs-15.727"},"notice":"GroundRules: Original legal text.
