{"data":{"id":"us-ky/krs-15.753","jurisdiction":"us-ky","citation":"KRS 15.753","heading":"Indemnification from financial loss in legal actions for Attorney General,","body":"Commonwealth's attorneys, county attorneys, and their staffs.\n(1) This section shall apply to:\n(a) The Attorney General and his or her staff;\n(b) A county attorney and his or her staff; and\n(c) A Commonwealth's attorney and his or her staff.\n(2) A person named in subsection (1) of this section who is sued for any act or\nomission in the course of his or her duties and who suffers actual financial loss,\nunreimbursed from a ny source, including any costs or attorney's fees awarded as a\nresult of the action, or any costs or reasonable attorney's fees incurred in defending\nthe action, shall be indemnified by the Commonwealth from funds appropriated to\nthe Finance and Administration Cabinet for the payment of judgments, to the extent\nof his or her actual financial loss.\n(3) The indemnification shall be contingent upon an express determination by the\nProsecutors Advisory Council that the act or omission which resulted in liability  or\nfinancial loss was within the scope and course of the officer's employment and\noccurred during the performance of duty and was committed or omitted in the good\nfaith belief that the act or omission was lawful and proper.\n(4) If the officer seeking inde mnification is the Attorney General, the determination\nreferred to in subsection (3) of this section shall be made by the Governor.\n(5) The indemnification shall not be construed to abrogate or limit any privilege,\nimmunity, or matter of defense otherwise available to the person claiming\nindemnification and shall not constitute a waiver of any privilege, immunity, or\nmatter or defense including the sovereign immunity of the Commonwealth.\n(6) The indemnification shall not be the subject of comment, directly or indirectly,\nbefore any jury hearing any cause of action in which the Attorney General, a county\nor Commonwealth's attorney, or a member of their staff is a party, and any\ncomment before the jury shall result in an immediate mistrial.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54544","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:34Z","sha256":"5a8f40270897fd90f6b6ee332991702ce4c94f3b52c425e08b6161f200d3822c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.750","next":"us-ky/krs-15.755"},"notice":"GroundRules: Original legal text.
