{"data":{"id":"us-ky/krs-15.850","jurisdiction":"us-ky","citation":"KRS 15.850","heading":"Lien against account of parent owing child support -- Notice -- Account","body":"activity fees -- Priority of lien.\n(1) When the Office of the Attorney General determines that the name, record address,\nand either Social Security number or tax payer identification number of an account\nwith a financial institution matches the name, record address, and either the Social\nSecurity number or taxpayer identification number of a parent who owes past -due\nsupport in an amount equal to or greater than one  (1) month's obligation, a lien or\nlevy shall, subject to the provision of subsection (3) of this section, arise against the\nassets in the account at the time of receipt of the notice by the financial institution at\nwhich the account is maintained. The off ice shall provide a notice of the match, the\nlien or levy arising therefrom, and the action to be taken to surrender or encumber\nthe account with the lien or levy for child support payment to the individual\nidentified and the financial institution holding the account. The financial institution\nshall have no obligation to hold, encumber, or surrender assets in any account based\non a match until receipt of the notice from the office.\n(2) The Office of the Attorney General shall provide notice to the individua l subject to\na child support lien or levy on assets in an account held by a financial institution\nwithin two (2) business days of the date that notice is sent to the financial\ninstitution.\n(3) A financial institution ordered to surrender or encumber an account shall be entitled\nto collect its normally scheduled account activity fees to maintain the account\nduring the period of time the account is seized or encumbered.\n(4) Any levy issued on an identified account by the Office of the Attorney General for\npast-due child support shall have first priority over any other lien or levy issued by\nthe Department of Revenue or any other agency, corporation, or association.","path":["KRS Chapter 15"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54354","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:35Z","sha256":"75a7e02c99e627e5b44ad21c8bb7211e873078c2fc7f68c530b4dc2387cd7634","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15.848","next":"us-ky/krs-15.852"},"notice":"GroundRules: Original legal text.
