{"data":{"id":"us-ky/krs-150.0242","jurisdiction":"us-ky","citation":"KRS 150.0242","heading":"Department procurements -- Applicability of Executive Branch Code of","body":"Ethics -- Administrative regulations.\n(1) Notwithstanding any provision of law to the contrary, the department shall conduct\nall procurements necessary for the performance of i ts duties in accordance with the\nprocurement procedures outlined in KRS Chapter 45A, this chapter, and the\nadministrative regulations promulgated under this chapter, but the department shall\nnot be subject to any provision of KRS Chapter 45A that requires the approval of\nany Finance and Administration Cabinet official for the department to proceed with\nany aspect of the procurement process. Upon approval of the commission, the\ncommissioner shall be deemed the chief purchasing officer for the purposes of\nconducting procurements for the department and shall have all of the authority and\nresponsibility with regard to the department's procurements as the secretary for the\nFinance and Administration Cabinet has for procurements under KRS Chapter 45A.\nAll departme nt personal service contracts, tax incentive agreements, and\nmemoranda of agreement shall be subject to review by the Government Contract\nReview Committee established by KRS 45A.705.\n(2) In its bidding and negotiation processes, the department, upon approv al of the\ncommission, shall perform its own bidding and procurement in accordance with the\nprocedures established by KRS Chapter 45A.\n(3) All members of the commission, the commissioner, and employees of the\ndepartment shall be subject to the requirements of the Executive Branch Code of\nEthics established under KRS Chapter 11A.\n(4) On or before January 1, 2024, the department shall promulgate administrative\nregulations pursuant to KRS Chapter 13A to implement its procedures for the\nprocurement of engineerin g services pursuant to this chapter and KRS 45A.800 to\n45A.835.","path":["KRS Chapter 150"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53583","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:43Z","sha256":"e99320c8af018dae375d709166003e3915c47778abfbc902c40ede69fe1a1c8b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-150.0241","next":"us-ky/krs-150.025"},"notice":"GroundRules: Original legal text.
