{"data":{"id":"us-ky/krs-150.027","jurisdiction":"us-ky","citation":"KRS 150.027","heading":"Hearing required before promulgation, amendment, or repeal of","body":"administrative regulations affecting property owners or occupants of property\nadjacent to a lake or other real property owned or controlled by the\ndepartment.\n(1) Not less than sixty (60) d ays nor more than ninety (90) days prior to the submission\nof a proposed administrative regulation, proposed amendment to an administrative\nregulation, or proposed repeal of an administrative regulation to the Administrative\nRegulation Review Subcommittee which affects property owners or occupants of\nproperty adjacent to any lake or other real property owned or controlled by the\ndepartment, the department shall:\n(a) Hold a public hearing at a time and location most convenient to the public at a\nlocation within ten (10) miles of the boundary of the lake so that the public\ncan make comments about the proposed administrative regulation, proposed\namendment to an administrative regulation, or proposed repeal of an\nadministrative regulation. Copies of the proposed  administrative regulation,\nproposed amendment to an administrative regulation, or proposed repeal of an\nadministrative regulation shall be distributed to members of the public\nattending the meeting without cost;\n(b) Advertise the hearing in accordance with KRS Chapter 424;\n(c) Electronically record the hearing and the comments made at the hearing; and\n(d) Within thirty (30) days of the close of the hearing, file a statement of\nconsideration with the Administrative Regulation Review Subcommittee\nsummarizing the comments made at the hearing and the department's response\nthereto containing the information required by KRS 13A.010.\n(2) The Administrative Regulation Review Subcommittee shall find deficient any\nproposed administrative regulation, proposed amendmen t to an administrative\nregulation, or proposed repeal of an administrative regulation covered by this\nsection which does not comply with the provisions of this section.","path":["KRS Chapter 150"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1937","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:43Z","sha256":"c13ccb27b4aa93d59cf742738a4769313a0813da491a59b2e0ab54922c42aca1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-150.026","next":"us-ky/krs-150.028"},"notice":"GroundRules: Original legal text.
