{"data":{"id":"us-ky/krs-150.097","jurisdiction":"us-ky","citation":"KRS 150.097","heading":"Indemnification by the Commonwealth of game warden who is sued in his","body":"or her individual capacity and personally suffers financial loss --\nIndemnification contingent upon findings that the act or omission which\nresulted in liability was lawful and  proper and within the officer's scope and\ncourse of employment -- Indemnification does not abrogate, limit, or constitute\na waiver of any privilege, immunity, or matter of defense otherwise available\nto the game warden.\n(1) Any game warden who is su ed for any act or omission in the line of duty and who\nhas a judgment for monetary damages rendered against him or her in his or her\nindividual capacity, and who personally suffers actual financial loss, unreimbursed\nfrom any source, by the enforcement and  satisfaction of the judgment, including\nany costs or attorney fees awarded pursuant thereto, shall be indemnified by the\nCommonwealth, from funds appropriated to the fish and game fund for the payment\nof judgments, to the extent of his or her actual financial loss.\n(2) The indemnification shall be contingent upon an express determination by the\ncommissioner that the act or omission which resulted in liability was within the\nscope and course of employment of the game warden, and occurred during the\nperformance of duty, and was committed or omitted in the good faith belief that the\nact or omission was lawful and proper.\n(3) The indemnification shall not be construed to abrogate or limit any privilege,\nimmunity, or matter of defense otherwise available to the game warden and shall\nnot constitute a waiver of any privilege, immunity, or matter of defense, including\nthe sovereign immunity of the Commonwealth.","path":["KRS Chapter 150"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55358","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:43Z","sha256":"151d237532f473f7415dbd3947bca43eb3b677f3b4ce707a320b0fe1ca22180a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-150.095","next":"us-ky/krs-150.100"},"notice":"GroundRules: Original legal text.
