{"data":{"id":"us-ky/krs-150.995","jurisdiction":"us-ky","citation":"KRS 150.995","heading":"Violations for which additional restitution shall be paid to department.","body":"(1) As used in this section, \"gross score\" means the Boone and Crockett score derived\nby calculating the measurements of the antlers of a white -tailed deer or elk in\naccordance with subsection (2) of this section.\n(2) The gross score of an antlered white -tailed deer or elk shall be calculated in\naccordance with the Boone and Crockett Club's \"Measuring and Scoring North\nAmerican Big Game Trophies, Third Edition, 2009\" and shall be taken by an\nofficial Boone and Crockett Club scorer. Measurements taken for th e purpose of\ncalculating the gross score may be taken at any time, with no drying time being\nrequired.\n(3) A person found guilty of a violation of the provisions of this chapter regarding the\ntaking, buying, selling, transporting, or possessing of an antle red white-tailed deer\nwith a gross score of more than one hundred twenty -five (125) inches shall pay to\nthe department an additional restitution value calculated by squaring the difference\nbetween the gross score and one hundred (100) and multiplying the r esulting\nnumber by one dollar and sixty-five cents ($1.65).\n(4) A person found guilty of a violation of the provisions of this chapter regarding the\ntaking, buying, selling, transporting, or possessing of an antlered elk with a gross\nscore of more than two  hundred eighty (280) inches shall pay to the department an\nadditional restitution value calculated by squaring the difference between the gross\nscore and two hundred fifty-five (255) and multiplying the resulting number by one\ndollar and sixty-five cents ($1.65).\n(5) A person found guilty of a violation of the provisions of this chapter regarding the\ntaking, buying, selling, transporting, or possessing of a bear shall pay to the\ndepartment an additional restitution value of one thousand dollars ($1,000).\n(6) A person found guilty of a violation of the provisions of this chapter regarding the\ntaking, buying, selling, transporting, or possessing of a turkey shall pay to the\ndepartment an additional restitution value of five hundred dollars ($500).\n(7) A person found guilty of a violation of the provisions of this chapter regarding the\ntaking, buying, selling, transporting, or possessing of a bobcat shall pay to the\ndepartment an additional restitution value of five hundred dollars ($500).\n(8) The commissioner or designee may bring a civil action to recover the restitution\nvalue owed to the department under subsection (3), (4), (5), (6), or (7) of this\nsection. A person who owes restitution to the department under subsection (3), (4),\n(5), (6), or (7) of this se ction shall forfeit his or her hunting license or, if license -\nexempt, the privilege to perform the hunting acts authorized by the license until the\nrestitution owed has been paid.\n(9) The restitution required by this section shall be in addition to all oth er restitution,\nreplacement costs, and civil or criminal penalties authorized by this chapter and the\nadministrative regulations promulgated hereunder.","path":["KRS Chapter 150"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42350","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:45Z","sha256":"f7d01d7e3ae26f2d9ca9cb85741d31e386f7b563c833449ff9fae7b63ac7c9a5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-150.993","next":"us-ky/krs-150.999"},"notice":"GroundRules: Original legal text.
