{"data":{"id":"us-ky/krs-151.112","jurisdiction":"us-ky","citation":"KRS 151.112","heading":"Planning process for management and development of water resources.","body":"(1) The cabinet shall develop a comprehensive and systematic planning process for the\nlong-range management and orderly development of the Commonwealth's water\nresources. The planning process shall generate over each biennium a plan for the\nimplementation of specific goals and management objectives for the cabinet to\nachieve in meeting the Commonwealth's water needs. The biennial plan shall serve\nas the basis for the cabinet's  budgeting process in allocating resources to the state's\nwater resource programs. The planning process shall be developed to:\n(a) Protect, conserve, develop, and utilize the water resource in a manner\nconsistent with the Commonwealth's duties for manageme nt of natural\nresources, the public's right to clean water, and the preservation of the natural,\nscenic, cultural, historic, and aesthetic values of the environment;\n(b) Provide a coordinated framework for cooperation among federal, interstate,\nstate, and local government agencies in the planning and management of\nwater resources, in a manner consistent with KRS Chapter 147 and KRS\n224.10-100(13);\n(c) Be both anticipatory of future needs and reactive to current needs;\n(d) Provide for public involvement in the establishment of the comprehensive and\nsystematic planning process, in plan development and implementation, and\nthe allocation and prioritizing of resources for water resource management\nand development;\n(e) Establish a process for the collection and co ordination of data regarding\nsurface water and groundwater availability and quality, including the presence\nof point and nonpoint sources of pollution, instream flow information,\nwithdrawal and use information, an assessment of flood damage and storm\nwater management problems, and an identification and assessment of future\ndata needs; and\n(f) Request technical assistance from any agency or organization the cabinet\ndeems necessary to carry out its duties as established in this chapter.\n(2) The continuous planning process shall include goals and objectives for groundwater\nand surface water quantity and quality management in order to assess the\neffectiveness of current programs in addressing the comprehensive water needs of\nthe Commonwealth and to gauge the nee d for new or different programs to\nrecommend to the General Assembly for legislation.","path":["KRS Chapter 151"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54092","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:45Z","sha256":"4f6519d56fd56611f8e06190ca1e9c4a1d4d054d5435fd4e4d02f43d72947046","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151.110","next":"us-ky/krs-151.113"},"notice":"GroundRules: Original legal text.
