{"data":{"id":"us-ky/krs-151.113","jurisdiction":"us-ky","citation":"KRS 151.113","heading":"Kentucky Water Resources Board.","body":"(1) The Kentucky Water Resources Board is hereby created for the purposes of\nassisting the cabinet in the implementation of KRS 151.110 and 151.112. The board\nshall be attached to the cabinet for administrative purposes.\n(2) The Kentucky Water Resources Board shall:\n(a) Assist the cabinet in conducting research and developing recommendations to\nenhance the quality of water resources accessible for agricultural production in\nthe state;\n(b) Research emerging water resources issues, including the adequacy of water\nsupplies available for agricultural production and in rural Kentucky;\n(c) Examine potential actions to address deficiencies in water supplies identified\nby the board;\n(d) Make recommendations for developing new and reliable water sources for key\nareas of farm production in Kentucky;\n(e) Develop and provide the cabinet with recommendations regarding water use\nefficiency for all agricultural water uses;\n(f) Develop recommendations for a strategy to promote water conservation in\nagricultural uses;\n(g) Develop and provide recommendations to the cabinet, the Department of\nAgriculture, and the Soil and Water Conservation Commission regarding on -\nfarm and rural community drought and water assessment, monitoring, and\nimprovements for agricultural purposes; and\n(h) Request technical assistance from the following groups in order to establish a\nprocess for the collection and coordination of data on surface and ground\nwater availability, water quality, the presence of point and nonpoint sources of\npollution, instream flo w, water withdrawal and use, flood damage and storm\nwater management, and the identification and assessment of future data needs:\n1. Kentucky Geological Survey;\n2. United States Geological Survey;\n3. Kentucky Water Resources Institute;\n4. Interagency Technical Advisory Committee on Groundwater;\n5. Soil and Water Conservation Commission; and\n6. Any other water group the board deems necessary.\n(3) The Kentucky Water Resources Board shall consist of eleven (11) members as\nfollows:\n(a) The secr etary of the cabinet or the secretary's designee, who shall serve as\nchair;\n(b) The Commissioner of the Kentucky Department of Agriculture or the\nCommissioner's designee, who shall serve as vice chair;\n(c) The dean of the University of Kentucky College of Agriculture, Food, and\nEnvironment or the dean's designee;\n(d) Six (6) members appointed by the Governor as follows:\n1. One (1) member selected from a list of three (3) submitted by the\nKentucky Association of Conservation Districts, who shall serve an\ninitial term of four (4) years;\n2. One (1) member selected from a list of three (3) submitted by the\nKentucky Chamber of Commerce, who shall serve an initial term of four\n(4) years;\n3. One (1) member selected from a list of three (3) submitted by the\nKentucky County Judge/Executive Association, who shall serve an\ninitial term of three (3) years;\n4. One (1) member selected from a list of three (3) submitted by the\nKentucky Farm Bureau, who shall serve an initial term of three (3)\nyears;\n5. One (1) member select ed from a list of three (3) submitted by the\nKentucky League of Cities, who shall serve an initial term of two (2)\nyears; and\n6. One (1) member selected from a list of three (3) submitted by the\nKentucky Rural Water Association, who shall serve an initial term of\ntwo (2) years; and\n(e) The board shall have two (2) nonvoting liaisons who are members of the\nGeneral Assembly, one (1) of whom shall be a member of the House of\nRepresentatives appointed by the Speaker of the House of Representatives,\nand one (1) of whom shall be a member of the Senate appointed by the\nPresident of the Senate.\n(4) Members appointed under subsection (3)(d) of this section shall serve a term of four\n(4) years and may be reappointed. A person appointed to fill a vacancy occurring\nprior to the expiration of a term shall be appointed for the remainder of that term.\n(5) (a) The Kentucky Water Resources Board shall meet at the call of the chair, and\nmembers shall not receive compensation for serving on the board.\n(b) Six (6) members shall constitute a quorum for the purposes of conducting\nbusiness.","path":["KRS Chapter 151"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45023","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:45Z","sha256":"e3c61da6ef39dc4480d9680ccd9a9098fc957a2fc28cd9f1f3cf794bfc57e747","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151.112","next":"us-ky/krs-151.114"},"notice":"GroundRules: Original legal text.
