{"data":{"id":"us-ky/krs-151.184","jurisdiction":"us-ky","citation":"KRS 151.184","heading":"Hearing conducted by hearing officer -- Final determination by secretary -","body":"- Use of counsel -- Subpoena power -- Hearings to be public.\n(1) All hearings under this chapter shall be held before a qualified hearing officer, who\nmay be a full -time employee of the cabinet, serve by contract, or be paid on a per\ndiem basis at the discretion of the cabinet.  After the conclusion of the hearing, the\nhearing officer shall within thirty (30) days make a report to the secretary and a\nrecommended order which shall  contain a finding of fact and a conclusion of law.\nIf the secretary finds upon written request of the hearing officer that additional time\nis needed, then the secretary may grant an extension.  The hearing officer shall serve\na copy of his report and rec ommended order upon all parties of record to the\nproceeding and they shall be granted the right to file within fourteen (14) days of\nreceipt exceptions thereto.  The secretary shall consider the report, exceptions, and\nrecommended order and decide the case.  The decision shall be served by mail upon\nall parties and shall be a final order of the cabinet.\n(2) Any party to a hearing conducted pursuant to this chapter may be represented by\ncounsel, make oral or written argument, offer testimony, cross -examine witnesses,\nor take any combination of such actions.  The record of the hearing shall be open to\npublic inspection, and copies thereof shall be made available to any person upon\npayment of the actual cost of reproducing the original.\n(3) In connection with a  hearing the cabinet shall issue subpoenas in response to any\nreasonable request by any party to the hearing requiring the attendance and\ntestimony of witnesses and the production of evidence relevant to any matter\ninvolved in the hearing.  In case of refu sal to obey a subpoena issued to any person,\nthe Franklin Circuit Court, upon application by the cabinet, may issue to that person\nan order requiring him to appear before the cabinet, there to produce documentary\nevidence if so ordered or to give evidence touching the matter under investigation or\nin question; and any failure to obey the order of the court may be punished by the\ncourt as a contempt of court.\n(4) All hearings conducted pursuant to this chapter shall be open to the public.","path":["KRS Chapter 151"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=2092","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:45Z","sha256":"607d83c02cf9d9b9249f6709038890e10c10bf694fab2c7c9c0e5742c6e72ab3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151.182","next":"us-ky/krs-151.186"},"notice":"GroundRules: Original legal text.
