{"data":{"id":"us-ky/krs-151.250","jurisdiction":"us-ky","citation":"KRS 151.250","heading":"Plans for dams, levees, embankments, dikes, bridges, fill, or other","body":"obstruction to be approved and permit issued by cabinet -- Jurisdiction of\nDepartment for Natural Resources.\n(1) Notwithstanding any other provision of law, no person and no city, county, or other\npolitical subdivision of the state, including levee districts, drainage districts, flood\ncontrol districts or systems, or similar bodies, shall commence the construction,\nreconstruction, relocation, or improvement of any dam, embankm ent, levee, dike,\nbridge, fill, or other obstruction, except those constructed by the Kentucky\nTransportation Cabinet, in the floodplain or floodway of any stream, unless the\nplans and specifications for such work have been:\n(a) Submitted by the person or political subdivision responsible for the\nconstruction, reconstruction, or improvement; and\n(b) Approved in writing by the cabinet and a permit issued.\nHowever, the cabinet by administrative regulation may exempt those dams,\nembankments, or other obstructions which are not of such size or type as to require\napproval by the cabinet in the interest of safety or retention of water supply.\n(2) No person, city, county, or other political subdivision of the state shall commence\nthe filling of, or place a buildin g, barrier, or obstruction of any sort in, any area in\nthe floodplain or floodway unless plans and specifications for such work have been\nsubmitted to and approved by the cabinet and a permit issued as required in\nsubsection (1) above.\n(3) Nothing in this section is intended to give the cabinet any jurisdiction or control\nover the construction, reconstruction, improvement, enlargement, maintenance, or\noperation of any drainage district, ditch, or system established for agricultural\npurposes. However, the ca binet may require approval prior to construction of\nstructures, dams, embankments, levees, bridges, fill, or other construction related to\nagricultural operations that impact the base flood of a stream.\n(4) The Department for Natural Resources through KRS Chapter 350 shall have\nexclusive jurisdiction over KRS Chapter 151 concerning the regulation of dams,\nlevees, embankments, dikes, bridges, fills, or other obstructions across or along any\nstream or in the floodway of any stream which structures are permitt ed under KRS\nChapter 350 for surface coal mining operations.","path":["KRS Chapter 151"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54097","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:45Z","sha256":"f20e55624d4c917399efbca52b39e4b51d871843e7d01e8aa0b5e9db0565ed19","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151.240","next":"us-ky/krs-151.260"},"notice":"GroundRules: Original legal text.
