{"data":{"id":"us-ky/krs-151.614","jurisdiction":"us-ky","citation":"KRS 151.614","heading":"Authority powers and duties -- Reports.","body":"(1) Stream Restoration and Mitigation Authorities established under KRS 151.610 to\n151.615 shall work in close partnership with local, state, and federal agencies in\nactively advocating for the restoration, protection, and enhancement of the\nwatershed through stream restoration and mitigation projects. To this end, an\nauthority may:\n(a) Recommend proposed stream restoration and mitigation projects to the 404\nMitigation Review Team for its consideration; and\n(b) Undertake the management of stream restoration and  mitigation projects and\nmay, in accordance with policies and regulations of the USACE, seek\napproval to be designated by the USACE as a qualified mitigation\norganization.\n(2) Stream Restoration and Mitigation Authorities may:\n(a) Establish a technical adv isory committee, soliciting participation from\nrepresentatives of area utilities and water, sewer, and sanitation districts,\nfederal, state, and local governments, and agencies thereof, consultants,\ncolleges, and universities to assist the authority in the  prioritization of\nproposed mitigation projects, the management of mitigation projects and in\nother efforts to improve watershed management;\n(b) Review and comment on plans developed by federal, state, and local\ngovernment agencies which relate to the wate rshed management and identify\nand recommend areas in which improved coordination of planning and project\ndesign could, on a case -by-case and a systemic basis, result in greater\nefficiencies and better outcomes for watershed management and water\nresource protection;\n(c) Initiate, sponsor, and participate in educational programs to increase public\nawareness and stakeholder involvement in water resources protection and\nwatershed management;\n(d) Prepare a six (6) year work plan, with annual review, for improvem ent of the\nwater resources of the watershed, including the:\n1. Identification and prioritization of site -specific stream restoration\nprojects;\n2. Development of recommendations for coordination of infrastructure\nimprovements and water resource enhancement;\n3. Solicitation of public participation in development of the work plan and\nof other strategies for water resource improvement and watershed\nmanagement; and\n4. Description of accomplishment during the previous year and the status\nof projects undertaken by  the authority of other entities within the\nwatershed;\n(e) Review project proposals for mitigation or restoration within the watershed to\nensure that the appropriate benchmarks and monitoring of preproject and\npostproject hydrologic and biologic conditions are included in the mitigation\nand restoration projects in  order to measure success in achievement of the\nproject goals;\n(f) Conduct pilot or demonstration projects for stream restoration and mitigation;\nand\n(g) Contract for technical assistance in undertaking any of the responsibilities\nauthorized under KRS 151.610 to 151.615.\n(3) Stream Restoration and Mitigation Authorities shall report to the Legislative\nResearch Commission by October 31 of each year on any stream restoration and\nmitigation work performed by the authority in the watershed, including the amount\nof mitigation funds received from USACE or from a permittee under a Section 404\npermit approved by the USACE, and any funding received from all sources and a\nlisting of upcoming restoration and mitigation projects authorized by the USACE or\nthe Department for Environmental Protection.\n(4) When performing any stream restoration or mitigation activity, the authority shall\ncomply with all permitting procedures set out in federal and state statutes and\nassociated regulations of the USACE and the Kentucky Energ y and Environment\nCabinet, and other local, state, and federal agencies, as appropriate.\n(5) The work plan provided for in paragraph (d) of subsection (2) of this section shall\nnot be construed as amending or affecting plans developed under local, state, o r\nfederal law, including plans developed under Section 208 of the Federal Water\nPollution Act, 33 U.S.C. sec 1288.","path":["KRS Chapter 151"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=2141","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:45Z","sha256":"b80fbb8dc21410110c0a11909fe4e3295af1f1e9ef3321b2b616f9ae0ae669c1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151.613","next":"us-ky/krs-151.615"},"notice":"GroundRules: Original legal text.
