{"data":{"id":"us-ky/krs-151.725","jurisdiction":"us-ky","citation":"KRS 151.725","heading":"Authority's duty to bring action for penalties or injunctive relief -- Venue.","body":"(1) The authority shall bring an action for the recovery of penalties provided for in KRS\n151.990, the payment of fees provided for in KRS 151.720, or for a restraining\norder, or a temporary or permanent injunction for the prevention or correction of a\ncondition constituting or threatening to constitute a violation of the administrative\nregulations promulgated by the authority, the long -range water resource plan, or a\ndrought response plan developed by the authority.\n(2) All actions for penalties and injunctive relief for violations of the administrative\nregulations promulgated by the authority, the long -range water resource plan, or a\ndrought response plan developed by the au thority shall be brought by the authority\nin the:\n(a) Circuit Court having jurisdiction of the defendant;\n(b) Circuit Court of the county in which the condition constituting or threatening\nto constitute a violation of the administrative regulations of the authority, the\nlong-range water resource plan or a drought response plan developed by the\nauthority is occurring; or\n(c) In the Franklin Circuit Court.","path":["KRS Chapter 151"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=2164","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:46Z","sha256":"c0c6ff6e4e395a95b3377ddd3008f565eabbbd8f556c7f9ffaf39aebebf7153f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151.723","next":"us-ky/krs-151.727"},"notice":"GroundRules: Original legal text.
