{"data":{"id":"us-ky/krs-151.728","jurisdiction":"us-ky","citation":"KRS 151.728","heading":"Preconstruction and construction reports -- Long-range planning","body":"document -- Execution of funded programs.\n(1) Beginning with the 2000-2002 biennium and each biennium thereafter, the authority\nshall submit to the General Assembly a six (6) year program  of preconstruction and\nconstruction activities to maintain or increase water available within the Kentucky\nRiver. The program shall include a two (2) year construction component that shall\nbe implemented as authorized by the General Assembly in the author ity's biennial\nbudget and a four (4) year preconstruction component that shall advise the General\nAssembly of the consistency of ongoing and long -term planning with the\nconstruction activities funded by the General Assembly.\n(2) The program shall be develo ped by considering, at a minimum, the following\nfactors:\n(a) The population to be served by the available water;\n(b) The social, economic, and environmental impact of program elements;\n(c) The condition of existing facilities critical to water availability;\n(d) The cost of maintaining, improving, replacing, or removing facilities; and\n(e) The dependence of communities within the river basin on specific Kentucky\nRiver dam pools or other sources of water.\n(3) The program shall include a four (4) year planning  document setting out\npreconstruction activities that include planning and design and an environmental\nanalysis of projects to maintain or increase water available within the Kentucky\nRiver and geotechnical and stability evaluations of the Kentucky River l ocks and\ndams.\n(4) The authority shall provide to the General Assembly a long -range planning\ndocument consisting of twenty (20) years for water supply projects being considered\nby the authority.\n(5) The authority shall be responsible for the execution of e ach six (6) year program as\napproved and authorized in the budget by the General Assembly and shall report\nany anticipated deviations from the authorized construction funding or\npreconstruction program to the Interim Joint Committee on Appropriations and\nRevenue.","path":["KRS Chapter 151"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=2166","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:46Z","sha256":"9bb04c607c88fc6023312d2c0e3c7d68874d825e1aaafb8b484093c9fb26263e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151.727","next":"us-ky/krs-151.7282"},"notice":"GroundRules: Original legal text.
