{"data":{"id":"us-ky/krs-151b.021","jurisdiction":"us-ky","citation":"KRS 151B.021","heading":"Criminal background  checks required for specified employees  and","body":"contract staff.\n(1) The  Education and Labor Cabinet shall require a national and state criminal\nbackground check for every prospective and current employee of the cabinet or\nits agencies, including contract staff, with access to or use of federal tax\ninformation. The criminal background investigation shall include a fingerprint\ncheck by the Department of Kentucky State Police and Federal Bureau of\nInvestigation, pursuant to the following requirements:\n(a) The cabinet shall require each employee with access to or use of federal\ntax information to submit a complete and legible set of fingerprints to the\nDepartment of Kentucky State Police on a fingerprint card issued by the\nFederal Bureau of Investigation;\n(b) The Department of Kentucky State Police shall submit the fingerprint card\nto the Federal Bureau of Investigation for a national criminal background\ncheck after a state criminal background check is conducted;\n(c) The results of a national and state criminal background check shall not be\ndistributed or otherwise released by the cabinet, except that the cabinet:\n1. Shall provide an employee the results of his or her national and\nstate criminal background check upon request; and\n2. May  introduce the results, under seal, as evidence in a legal\nproceeding that involves a challenge to any personnel action taken\nby the cabinet based in whole or in part on information contained in\nthe results; and\n(d) Any  fee charged by the Department of Kentucky State Police or for the\nFederal Bureau of Investigation background check shall be an amount no\ngreater than the actual cost of processing the request and conducting the\nbackground check.\n(2) The  cabinet or its agencies shall promulgate administrative regulations in\naccordance with this section and KRS Chapter 13A to implement this section.","path":["KRS Chapter 151B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52315","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:46Z","sha256":"3fcde64c39017b873e1ef7af5491d290cfca955587647e513d2661842611350e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151b.020","next":"us-ky/krs-151b.022"},"notice":"GroundRules: Original legal text.
