{"data":{"id":"us-ky/krs-151b.325","jurisdiction":"us-ky","citation":"KRS 151B.325","heading":"Manufacturer's duty to provide substitute assistive device or rental","body":"reimbursement during warranty repair -- Conditions.\n(1) Whenever an assistive device covered by a manufacturer's express warranty is\ntendered by a consumer to the dealer from whom it was purchased or exchanged for\nthe repair of a defect, malfunction, or nonconformity to which the warranty is\napplicable, and at least one (1) of the following conditions exists, the manufacturer\nshall provide directly to the consumer for the duration of  the repair period, a\ncomparable replacement assistive device or a rental assistive device reimbursement\nto pay for the cost incurred by the consumer for renting a comparable replacement\nassistive device. The applicable conditions are as follows:\n(a) The repair period exceeds ten (10) working days, including the day on which\nthe device is tendered to the dealer for repair; or\n(b) The defect, malfunction, or nonconformity is the same one for which the\nassistive device has been tendered to the dealer for repa ir on at least two (2)\nprevious occasions.\n(2) This section applies for the period of the manufacturer's express warranty or the\nperiod prescribed in KRS 151B.305(2), whichever is greater, whether or not the\nrepairs extend beyond that period.","path":["KRS Chapter 151B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=2239","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:47Z","sha256":"137e9e67b8c9d9cbd12746378f4e5a3afb3406318f29974f3427dc3272df37ea","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151b.320","next":"us-ky/krs-151b.330"},"notice":"GroundRules: Original legal text.
