{"data":{"id":"us-ky/krs-151b.330","jurisdiction":"us-ky","citation":"KRS 151B.330","heading":"Consumer's right of action for damages -- Nonlimitation of rights and","body":"remedies -- Nonwaiverability.\n(1) In addition to pursuing any other remedy, a consumer may bring an action to\nrecover for any damages caused by a violation of KRS 151B.300 to 151B. 335 in a\ncourt of appropriate jurisdiction in the county where the consumer resides or where\nthe manufacturer resides or has its principal place of business. The court shall award\na consumer who prevails in such an action the amount of any pecuniary loss,\ntogether with costs, disbursements, and reasonable attorney's fees, and any equitable\nrelief the court determines is appropriate.\n(2) KRS 151B.300 to 151B.335 shall not be construed to limit rights or remedies\navailable to the consumer under any other law,  and the remedies provided under\nKRS 151B.300 to 151B.335 are inclusive and in addition to any other remedies\nprovided by law.\n(3) Any agreement entered into by a consumer which waives, limits, or disclaims the\nrights set forth in KRS 151B.300 to 151B.335 shall be void as contrary to public\npolicy.","path":["KRS Chapter 151B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=2240","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:47Z","sha256":"8e4deb395bfbcbd4c9b84dcc2f773e5c6ab5eda84ea941984121f975d037fb02","source_id":"us-ky","stale":false,"prev":"us-ky/krs-151b.325","next":"us-ky/krs-151b.335"},"notice":"GroundRules: Original legal text.
