{"data":{"id":"us-ky/krs-153.180","jurisdiction":"us-ky","citation":"KRS 153.180","heading":"Kentucky Foundation for the Arts -- Purpose -- Funding -- Board of","body":"trustees -- Support staff -- Annual report.\n(1) There  is hereby established a nonprofit foundation to be known  as the\nKentucky Foundation for the Arts. The purpose of the foundation shall be to\nenhance  the stability of Kentucky's arts organizations and  to ensure\nKentuckians have access to the arts through the support of an endowment\nfund.\n(2) Funding for the foundation shall be obtained through state appropriations, gifts,\ngrants, and any other funds from the public and private sectors. The foundation\nboard shall have the authority to solicit, accept, and receive contributions from\nthe  public and  private sectors to match  public funding. Moneys  in the\nfoundation fund shall not lapse to the general fund at the end of the fiscal year.\nMoneys  in the foundation fund shall be invested by the Office of Financial\nManagement  established in KRS  42.0201 consistent with the provisions of\nKRS  Chapter 42, and  interest income  earned shall be  credited to the\nfoundation fund. The foundation board may use the investment income for the\npurpose of awarding matching grants to nonprofit arts organizations to carry\nout the following programs:\n(a) The  Performing Arts and Visual Arts Touring Subsidy Program shall\nsupport tours and  exhibitions for the education and  enjoyment of\naudiences throughout the state; and\n(b) The  Institutional Stabilization Program shall provide operating funds to\nachieve short-term or long-term stability of arts organizations.\n(3) The  foundation shall be governed by a board of trustees consisting of six (6)\nmembers  appointed by the Governor on recommendations from the Kentucky\nArts Council. For the initial appointments, the Governor shall appoint two (2)\nmembers  to serve two (2) year terms; two (2) members  to serve three (3) year\nterms; and two (2) members  to serve four (4) year terms. Thereafter, the\nGovernor shall make all appointments for a term of four (4) years. The board\nshall elect by majority vote a chair and other officers deemed necessary. Board\nmembers  shall not receive any compensation for their services, but may  be\nreimbursed in accordance with the provisions of KRS  49.040 and 45.101 for\nactual and necessary expenses incurred in the performance of their duties.\n(4) The  foundation board shall perform duties and  responsibilities deemed\nnecessary to fulfill the purposes of this section. The foundation board shall\nestablish by administrative regulation procedures for administration of the\nfoundation, eligibility criteria for the award of grants, appropriate matching\ncontributions from grant recipients, and evaluation and reporting requirements.\n(5) The foundation shall be attached to the Office of the Secretary of the Tourism,\nArts and Heritage Cabinet for administrative purposes only. The Kentucky Arts\nCouncil shall provide to the foundation by agreement staff support and office\nfacilities for which reasonable charges and fees may  be levied against the\nfoundation fund.\n(6) The  foundation board shall submit an annual report to the Governor and the\nLegislative Research Commission listing the sources of funds acquired and\nexpended.","path":["KRS Chapter 153"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46258","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:50Z","sha256":"058da5ef456d03c1e43ea00e00745953bb213ac0c15881e69aabf824baf0ddeb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-153.140","next":"us-ky/krs-153.210"},"notice":"GroundRules: Original legal text.
