{"data":{"id":"us-ky/krs-153.420","jurisdiction":"us-ky","citation":"KRS 153.420","heading":"Powers and duties of corporation.","body":"The Kentucky Center for the Arts Corporation:\n(1) Shall supervise construction of the Kentucky Center for the Arts in conjunction with\nthe Finance and Administration Cabinet, and shall provide all management\nfunctions for the facility and for any other pro perty acquired or leased pursuant to\nits powers under this section;\n(2) May take, acquire and hold property, and all interests therein, by deed, purchase,\ngift, devise, bequest, lease or eminent domain, or by transfer from the State Property\nand Buildings Commission, and may dispose of any property so acquired in any\nmanner provided by law. In the exercise of its power of eminent domain, it shall\nproceed in the manner provided in the Eminent Domain Act of Kentucky, KRS\n416.540 to 416.680;\n(3) May consult or  enter into agreements with other segments of the arts and\nentertainment industry to provide technical, professional, or management support or\nassistance, consistent with its purpose and mission;\n(4) May issue revenue bonds, subject to procedures which sha ll be established by the\nFinance and Administration Cabinet, solely payable from the charges, revenues,\nrentals, and other funds pledged for their payment for the purpose of paying all or\nany part of the cost of any project or for the acquisition of property;\n(5) Shall promote the growth and development of the arts, convention trade, tourism\nand the hotel industry within Jefferson County and the Commonwealth, through\nutilization of the Kentucky center and activities authorized in this section to\nenhance these and the public interest;\n(6) May adopt administrative regulations, as provided in KRS Chapter 13A, governing\nthe operation, maintenance or use of property under its custody and control;\n(7) May levy a surcharge on tickets for all functions held within the center to contribute\nto operating revenue;\n(8) May receive tax revenues from any governmental unit, and financial contributions\nof local governments, private persons and foundations;\n(9) Shall have exclusive control of all exhibitions, performances and concessions in the\nCenter for the Arts. The corporation shall have a prior lien upon the property of any\nprivate exhibitor, concessionaire, or other person holding an exhibition or\nperformance or operating a concession in the center, and may sell such prop erty\nupon ten (10) days' notice to satisfy any indebtedness;\n(10) Shall develop in conjunction with local hotels, and the arts and entertainment\nindustry, tourist packages including performance and group plans, and shall\nparticipate with local hotels and c onvention bureaus in attracting non -arts related\nconferences and conventions;\n(11) May establish an executive committee from among its membership with full\nauthority to act between its meetings to the extent delegated by the corporation;\n(12) May sue and be sued and maintain and defend legal actions in its corporate name;\n(13) May, if the corporation elects, be exempt from the provisions of KRS 56.065 to\n56.180, and, with the approval of the secretary of the Finance and Administration\nCabinet and the Depart ment of Insurance, purchase from the funds allotted to the\ncorporation property insurance for buildings and contents from responsible\ninsurance companies doing business in this state; and\n(14) May purchase liability insurance for the protection of the corporation and its\nemployees from liability arising in the operation of the center.","path":["KRS Chapter 153"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=2482","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:50Z","sha256":"765d051a4a8d70386e9ea59afca2fd4f7e26fa779d5e9e2d9ab1771ea2177d48","source_id":"us-ky","stale":false,"prev":"us-ky/krs-153.410","next":"us-ky/krs-153.430"},"notice":"GroundRules: Original legal text.
