{"data":{"id":"us-ky/krs-154.10-010","jurisdiction":"us-ky","citation":"KRS 154.10-010","heading":"Kentucky Economic Development Partnership -- Membership --","body":"Vacancies -- Meetings.\n(1) (a) The Kentucky Economic Development Partnership, a board governing the\nCabinet for Economic Development, is created and established, performing\nessential governmental and public functions and purposes essential to\nimproving and promoting the health and general welfare of the people of the\nCommonwealth through sustainable economic development, as prescribed in\nKRS 154.1-020.\n(b) The board shall have reo rganization powers and authority as prescribed in\nKRS 12.028 and shall constitute an administrative body as defined in KRS\n12.010, but it and the cabinet shall not be subject to reorganization by the\nGovernor, KRS Chapter 12 notwithstanding.\n(c) The board shall serve as the governing body of the cabinet and shall exercise\nall powers and authorities conferred upon it by statute, including, but not\nlimited to, the following functions:\n1. Strategic planning;\n2. Finance;\n3. Business assistance;\n4. Marketing and promotion;\n5. Community development;\n6. Workforce development;\n7. Innovation; and\n8. All economic development powers and authorities not specifically\nconferred by statute to another agency or authority of state government.\n(2) The board shall consist of f ourteen (14) voting members and two (2) nonvoting\nmembers. The fourteen (14) voting members shall consist of the Governor, the\nsecretary of the Finance and Administration Cabinet, the secretary of the Public\nProtection Cabinet, the secretary of the Energy and Environment Cabinet, the\nsecretary of the Education and Labor Cabinet, the Commissioner of Agriculture or\nhis or her designee, and eight (8) private sector members who shall be appointed by\nthe Governor. The secretary of the Governor's Executive Cabine t shall serve as a\nvoting member upon the absence of the Governor. The secretary of the Education\nand Cabinet for Economic Development and the secretary of the Tourism, Arts and\nHeritage Cabinet shall serve as nonvoting members.\n(3) The governing bodies of each of the following organizations shall nominate two (2)\npersons from each of the six (6) Congressional districts of the Commonwealth and\ntwo (2) persons from the state at large, as candidates for appointment as private\nsector members to the board:\n(a) The Kentucky Association for Economic Development;\n(b) The Kentucky Association of Manufacturers;\n(c) The Kentucky State AFL-CIO;\n(d) The Kentucky Farm Bureau Federation;\n(e) The Kentucky Chamber of Commerce; and\n(f) The National Federation of Independent Businesses/Kentucky.\n(4) The Governor shall select the original eight (8) private sector members from the\naggregation of the lists provided pursuant to subsection (3) of this section, with at\nleast one (1) appointment being chosen from each organization's list and at least one\n(1) appointment being chosen from each Congressional district. Appointments to\nvacancies shall be made in the same manner as prescribed in this subsection and\nsubsection (3) of this section, except that there is no requirement that the vacancy be\nfilled from the same organization's list as the original appointment.\n(5) All appointments shall be for four (4) years.\n(6) In making appointments to the board, the Governor shall assure broad geographical\nrepresentation, as well as representation from the major sectors of Kentucky's\neconomy by leading executives with a knowledge of the problems of large and\nsmall businesses, local economic development, and the transfer of research and\ndevelopment from the laboratory to t he marketplace. In filling vacancies, the\nGovernor shall assure the continuous representation on the board of broad\nconstituencies of Kentucky's economy, including manufacturing and agriculture.\n(7) Vacancies on the board which may occur from time to time shall be filled as\nfollows:\n(a) Any vacancy which occurs shall be filled for the unexpired term in accordance\nwith the procedures established in subsections (3) and (4) of this section.\n(b) If any private sector member misses more than two (2) consecutive meetings\nof the board, then that position shall be declared vacant and filled in\naccordance with this section.\n(8) The board shall meet semiannually and at other times upon call of the chairman or a\nmajority of the board.\n(9) A quorum shall be a majority of the voting membership of the board.\n(10) A quorum shall be required to organize and conduct the business of the board,\nexcept that an affirmative vote of eight (8) or more members of the entire board\nshall be required to terminate the employment of the c abinet's secretary, and to\nadopt or amend the strategic plan.\n(11) Private sector members shall serve without compensation but shall be reimbursed\nfor all reasonable, necessary, and actual expenses.\n(12) All existing duties, responsibilities, functions, pe rsonnel, programs, funds,\nobligations, records, and real and personal property of the Cabinet for Economic\nDevelopment, as of July 14, 1992, shall be under the authority and control of the\nboard.\n(13) The Cabinet for Economic Development shall give prompt notice to the\nCommissioner of Agriculture when the cabinet receives information about an\nagriculture-related economic development opportunity, including but not limited to\nthe following:\n(a) Agricultural production;\n(b) Food or beverage processing; or\n(c) An economic activity that uses agricultural products as inputs.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53073","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:52Z","sha256":"8bdb9ec07a35c30e05ed7eb0a43d5da6a8e7faf8b94fb8d6be5226379271db5f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-154.1-750","next":"us-ky/krs-154.10-020"},"notice":"GroundRules: Original legal text.
